RESOLUTION DECLARING FISH CANNERIES A PUBLIC NUISANCE
WHEREAS, there are various waterfront properties
in the City of National City which are vacant, and available
for industrial development, and
WHEREAS, it has come to the attention of the City
Council that a proposed use of said industrial, waterfront
properties is that of a fish cannery, and
WHEREAS, the City Council, based on their experience
of similar installations in San Diego County, finds that fish
canneries generate smelly, noxious odors, and
WHEREAS, prevailing winds would carry such noxious
odors across the length and breadth of the City of National
City, and
WHEREAS, the spreading of such noxious odors would
severely depress the value of other real properties in the City
of National City, and
WHEREAS, the spread of such noxious odors would sev-
erely impair the beneficial enjoyment of residential properties
in the City of National City and adversely affect the health
and welfare of the City of National City and the people therein;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of National City finds, determines, and declares
that the operation of a fish cannery, and its relating access-
ory uses, would be a public nuisance and the same is hereby
forbidden within the limits of the City of National City.
BE IT FURTHER RESOLVED that the term "fish cannery"
as used in this resolution means any process by which fish, or
parts thereof, are converted from their natural state into any
food product, by-product, or fertilizer; and the term also
includes all the related accessory processes as normally
associated with fish canneries.
