RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISI- TION OF CERTAIN PROPERTY FOR AN INTEGRATED, PUBLICLY OWNED AND OPERATED WATERWORKS SYS- TEM FOR THE PUBLIC USE OF C3TY OF NATIONAL CITY AND ITS INHABITANTS IT IS HEREBY RESOLVED by the National City City Council as follows: SECTION 1. The National City City Council hereby finds, determines and declares that the public interest and necessity require the establishment, acquisition, construct- tion, maintenance and completion by the City of National City of an integrated, publicly owned and operated waterworks sys- tem for the public use of the City of National City and its inhabitants, including works and facilities for the production, storage, treatment, transmission and distribution of water, including dams, water storage reservoirs, tanks, treatment plant, water wells, water in storage, pumping stations, water transmission and distribution mains, services, build- ings, structures and such appurtenances and appurtenant works, including water rights, lands, easements, rights of way, pipes, hydrants, pumps, valves, fittings, meters, machinery, equipment, materials, apparatus and other prop- erty, necessary for said waterworks system. SECTION 2. The public use and necessity require the acquisition for and in connection with said integrated, publicly owned and operated water system, the property here- inafter described. SECTION 3. Said integrated, publicly owned and operated water system for the public use of the City of National City and its inhabitants is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. SECTION 4. That insofar as any of the property described in this resolution has heretofore been dedicated to the public use, the acquisition and use of such property by the City of National City far an integrated, publicly owned and operated water system for use of the City of Nation- al City and its inhabitants is for a more necessary public use. SECTION 5. That insofar as the property described in this resolution has heretofore been dedicated to the public use outside the boundaries of the City of National City, the acquisition and use of such property by the City of National City shall be subject to the legal obligation to continue supplying water to all persons legally entitled to receive water from said property and interests in property. SECTION 6. The property necessary for said public improvement is situated in the County of San Diego, State of California, and is more particularly described in Exhibit "A", attached hereto and by this reference made a part hereof. SECTION 7. The City Attorney is hereby authorized, empowered and directed to prepare and prosecute such proceed- ing or proceedings in the proper court having jurisdiction thereof as are necessary for such acquisition in the name and on behalf of the City of National City against all owners and claimants of the above described property for the purpose of condemning and acquiring said property and interests in property. Utility Plant in Service: Franchises and Consents Other Intangible Plant Land and Land Rights (including land owned in fee, licenses, privileges, easements, rights of way, diversion rights, submersion rights and water rights) Water Supply Structures and Improvements Collecting and Impounding Reservoirs (including dams) Wells Supply Mains Other Source of Supply Plant Pumping Operations Structures and Improve- ments Pumping Equipment Other Pumping Plant Water Treatment Plant Structures and Im- provements Water Treatment Equipment Transmission and Distribution Structures and Improvements Reservoirs and Tanks Transmission and Distribution Mains Fire Mains Services Meters Hydrants Other Transmission and Distribution Plant General Plant Structures and Improvements Office Furniture and Equipment Transportation Equipment Stores Equipment Laboratory Equipment Communication Equipment Power Operated Equipment Tools, Shop and Garage Equipment Other General Plant Other Tangible Property B.) Material and Supplies - Utility. C.) Books, records, documents, maps and drawings related to the water supply and distribution system, land and land rights, but excluding unrelated corporate and shareholders' records. D.) Operating agreements and contracts related to the water supply and distribution system. Expressly excluding: cash on hand or on deposit; special deposits; working funds; temporary cash investments, accounts receivable; receivables from associated companies; notes receivable; unbilied revenues; investments in associated companies or other investments; and prepayments.
