HomeMy WebLinkAboutCC RESO 9743RESOLUTION NO. 9743 A RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC IN- TEREST, CONVENIENCE AND NECESSITY OF THE CITY OF NATIONAL CITY REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE OF PUBLIC STREET ACROSS CERTAIN DESCRIBED LAND IN THE CITY OF NATIONAL CITY, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA; AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF FEE TITLE TO SAID PROPERTY 1O BE USED BY SAID CITY FOR SAID PURPOSE; AND DECLARING THE IN- TENTION OF THE CITY OF NATIONAL CITY TO ACQUIRE SAID PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS; COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA IN AND FOR THE COUNTY OF SAN DIEGO FOR THE PURPOSE OF ACQUIRING SAID PROPERTY. (20th Street and La Siesta Way) BE IT RESOLVED by the Council of the City of National City as follows: SECTION 1: That the public interest, convenience and necessity of the City of National City and the inhabitants thereof require the construction, operation and maintenance of public streets across that certain parcel of real property identified as Parcel A and Parcel B herein, located in the City of National City, County of San Diego, State of Calif- ornia, and fully described in Exhibit "A" hereto, which said Exhibit is attached hereto and by this reference incorporated herein and made a part hereof as though set forth in full, SECTION 2: That the public interest, convenience, and necessity of said City and inhabitants thereof demand the acquisition and taking of fee title to said property for the construction, operation and maintenance of the aforesaid pub- lic streets lying within the City of National City, County of San Diego, State of California, SECTION 3: That the property to be condemned, being Parcels A and B, is fully described in Exhibit "A" attached hereto and incorporated by reference in Section 1 above, SECTION 4: That the taking and acquiring by said City of the property described in Exhibit "A" hereto is deemed necessary for the construction, operation and maintenance of said public streets by the City of National City and the inhabitants thereof for municipal purposes; that such uses are public uses and that for such public uses it is necessary that the City of National City condemn and acquire the prop- erty hereinabove described; that the property hereinabove described is to be used for the construction, operation and maintenance of the said public streets, SECTION 5: That the City Attorney of the City of National City b e and he is hereby authorized and directed to commence an action in the Superior Court of the State of California in and for the County of San; Diego, in the name and on behalf of the City of National City against all owners and claimants of the above described property rights for the purpose of condemning and acquiring said property rights for the use of said City. PASSED AND ADOPTED this 2e/ch day of January, 1969. ATTEST: CITY CLERK PARCEL A: All that portion of Lot No. 262 in Lincoln Acres Annex No. 2 in the City of National City, County of San Diego, State of Calif- ornia, according to Map thereof No. 1748 recorded in the office of the County Recorder of said County, being more particularly described as follows: Beginning at the Southeasterly corner of said Lot No. 262 as shown on Map No. 1748, said point being also the True Point of Beginning; thence, Southwesterly along the Southeasterly boundary of said Lot No. 262 a distance of 25.00 feet to a point, said point being the point of tangency of a 10.00 foot radius curve, concave Northwesterly, the center of the circle of which bears Northwesterly, on a line which is parallel with and 25.00 feet Southwesterly, measured at right angles, from the Northeasterly boundary of said Lot No. 262; thence, Easterly and Northerly along said 10 foot radius curve, a distance of 15.71 feet; thence, Northwesterly parallel with and 15.00 feet Southwesterly from the Northeasterly boundary of said Lot No. 262, to a point in the Northwesterly boundary thereof; thence, Northeasterly along the Northwesterly boundary of said Lot, to the Northeasterly corner thereof; thence, Southeasterly along the Northeasterly boundary of said. Lot No. 262 a distance of 63.21 feet, to the True Point of Beginning. PARCEL B: Request embankment and access rights for the purpose of embankment facilities, together with the right to enter upon and to pass over and along, and to remove and or deposit mater- ials thereon, of Lot 262, Lincoln Acres.
