RESOLUTION GRANTING ZONE. VARIANCE PURSUANT TO
ORDINANCE NO. 962
(Zone Variance Z-63, Sweetwater Heights Subdivision)
The City Council of the City. of National City does
hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary hard-
ship, and a result .inconsistent with the general purpose and
intent of. Ordinance No. 962 would occur through strict appli-
cation of the provisions of said Ordinance to that .certain
real property hereinafter described.
2. That a Petition requesting a variance has been
filed pursuant to the provisions of Section 12 of said ordin-
ance and said Petition complies with all the requirements of
said section.
3. That the National City Planning Commission did
hold a hearing on said Petition and did recommend to the City
Councilthat a. variance be denied.
4. That .the gr.anting of a variance with reference
to the property hereinafter described will not defeat, but
rather will carry .out the general intent and purpose of the
National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said
Ordinance No. 962.be.and hereby is granted with refer.ence.to
all thecertain real property situated in the City of National
City, California, more particularly described as follows:
Lots 1 through 234 Sweetwater Heights Subdivision,
Map No. 48.05. filed in the Office of the County Recorder,
San Diego County, State of California.
6. That the variance hereby granted is as follows:
Reduction in front yard setback to permit off-street parking
subject to the following conditions:
a. A complete development plan forthe entire
parcel shall be approved by the Planning Commission for each
individual parcel of land taking advantage of subject variance.
b. Said development plans shall show all ex-
isting and proposed structures, garages or carports to be
to be converted, proposed off-street parking space, lands-
caping, accessory structures, lot dimensions, ,setback dimen-
sions, and .any .other information to clearly show the proposed
development.
c. Property owners of all existing structures
which have been converted to living floor area shall file
said development plans and shall s.e.cure a building permit
from the. Building Department of the City of National City
and shall show evidence said structureconverted to living
floor area meets all applicable code and setback requirements.
Said structure enclosure shall conform with all other pro-
visions of. the Zoning Ordinance of. the City of National City.
d. No portion of any parked automobile shall
encroach within the public right-of-way of any dedicated
street.
e. No motor vehicle may be parked for any
time.shich shall block the use of the public sidewalk.
f. Said parking space shallbe maintained as
an open space area and at no time shall any .structure be
permitted within the front yard setback.
g. Said off street parking space shall be
utilized for thestorage of motor vehicles. .only .and at no
time shall it be used for the storage of boats., house'trail-
ers, accessory trailers, or similar., equipment.
h.- No major automobile repair may bedone in
said area. The presence on any lot or parcel of land of
any automobile which, for a period exceeding two weeks, has
not b.e.en capable of operating under its own power or from
which parts have been removed shall constitute prima facie
evidence of a violation to subjectvariance.
i. No dismantling or wrecking of motor
vehicles or the dumping of wrecked vehicles or their parts
shall be permitted.
j. Not more than fifty percent .(50%) of the
front yard frontage shall be utilized for off-street parking.
k. Off -.street parking as permitted shall be
contained within thedriveway entrance to subject structure.
Any enlargement shall be installed in conformance with all
applicable codes and ordinances.
1. No storage shall be permitted within an un-
enclosed carport, until said carport has been enclosed subject
to the conditions contained within this variance.
m. All property shall be maintained in accord-
ance with thedeed restrictions placed against subject property.
n. At no time after the granting of subject var-
iance shall the property owner permit the accumulation ofdebris,
trash and/or weeds within the area of the property upon which
said variance is granted or within the parkway adjacent to said
property..
7. In the event that the City Council should here-
after find and determine that the conditions above set forth
have not been satisfied, it may declarethisvariance void and
of no further effect.
