HomeMy WebLinkAboutCC RESO 9798RESOLUTION NO. 9798 RESOLUTION IN SUPPORT OF ASSEMBLY BILL 715 AND THE REPEAL OF THE STATE PAINTING STANDARDS. WHEREAS, the State Legislature in 1963 enacted Assembly Bill 1963 which amended Section 17922 of the Health and Safety Code requiring that the minimum painting standards for home construction loans of the Federal Housing Authority and Department of Veterans Affairs shall pertain to all residential construction, alterations and additions; and WHEREAS, there have been two unsuccessful attempts to repeal these mini- mum painting standards on the basis of not involving public health, safety or wel- fare; and WHEREAS, the original legislation in 1963 was strongly opposed by building officials, architects, builders, contractors, the League of California Cities, the City of National City; and many other organizations; and WHEREAS, the development of minimum standards and inclusion of them into the State regulations will be completed in 1969 requiring all cities, counties, and cities and counties, to comply with them as the minimum standards for painting; and WHEREAS, the enforcement of such minimum standards will require the addi- tion of a large number of additional inspectors on the staff of the Department of Building and Housing as well as other additional personnel to properly implement the regulations; and WHEREAS, the citizens of National Citywill be required to file applica- tions with the Department of Building and Housing in order to assure compliance with the minimum standards; and WHEREAS, the costs of inspection must be covered by the fee to be charged for the required inspection and which fee will be disproportionate to the cost of the painting when said work is done by the property owner or his agent; and WHEREAS, the Building and Housing Advisory and Appeals Board recommends that since such minimum painting standards will impose an unwarranted and economi- cally burdensome regulation upon the property owners that the painting standards should be repealed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that it shall be the policy of the City to support Assembly Bill 715 and the repeal of the minimum painting standards as contained in Section 17922 of the Health and Safety Code of the State of California. BE IT FURTHER RESOLVED, that copies of this Resolution be forwarded to the State Assembly Committee on Urban Affairs and Housing, State legislative representatives of the County of San Diego, the League of California Cities, and the State Department of Housing and Community Development. PASSED AND ADOPTED this 8th day of April, 1969.
