HomeMy WebLinkAboutCC RESO 9804RESOLUTION NO. 9804 RESOLUTION OF INTENTION (27th Street and "A" Avenue Assessment District No. 168) The City Council of the City of National City, California, does hereby resolve, determine and order as fol- lows: Section 1. The public interest and convenience re- quire and it is the intention of the City Council of said City of National City to order the following work to be done or improvement to be made in the City of National City, to wit: that 27th Street and "A" Avenue, Assessment District No. 168 be improved as follows: curb, gutter, sidewalks, driveways, and work incidental thereto and that any other work auxil- iary to any of the above and which may be required to carry out the same be performed. Section 2. The attention of all persons is directed to the fact that all of said classes of work above described may not be constructed upon all of the streets or public ways above mentioned in their entirety, but only upon the particu- lar locations shown on the plans, specifications and drawings. Section 3. The estimated cost of said work, inclu- ding incidental expenses, is the sum of $22,075.72. The City has budgeted the sum of $4,074.69 as a contribution toward said cost. Section 4. All the aforesaid work or improvement shall be constructed at the grades, along the lines, between the points, of the dimensions, at the places and in the man- ner shown on the plans, specifications, profiles and drawings for the said work approved and adopted by this Council on April 22 , 1969, by Resolution No. 9803 . Said plans, specifications, profiles and drawings are on file in the office of the City Clerk of the City of National City in the City Hall of said City, and reference is hereby made to said plans, specifications, profiles and drawings for a full and detailed description of said proposed work and for a description of the grades at which said work is to be done. Said grades are hereby adopted and established as the official grades for all purposes in connection with proceedings pursuant to this Resolution of Intention. Notice is hereby given that said grades may be new and different from those heretofore established or existing, or may be, and in some cases are, different from existing ground levels. Section 5. This City Council hereby makes the expense of said work charge- able upon a district, which district this City Council hereby declares to be the district benefited by the said work and to be assessed to pay the cost and expenses thereof. For a description of said district, reference is hereby made to a Map of said district heretofore approved by this City Council on file in the office of the City Clerk and designated as 'MAP OF ASSESSMENT DISTRICT NO. 168 FOR STREET IMPROVEMENT ON 27th STREET AND "A" AVENUE, all in the City of National City, California." This map indicates by a boundary line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. Section 6. All public streets or public parks, and all easements or rights of Way belonging to the public, and also all property owned by the United States of America or the State of California now in use in the performance of a public function are hereby specifically excluded from this assessment district. Section 7. Serial bonds bearing interest at the rate of six per cent (6%) per annum shall be issued to represent each assessment of fifty dollars ($50.00) or over remaining unpaid for thirty (30) days after the date of recorda- tion of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second of January next succeeding the next September 1 follow- ing their date. Said bonds shall be payable to bearer and there shall be added after the redemption clause in the bond the following language, "together with a premium of five per cent (5%) of said unmatured principal." Said bonds are to be issued pursuant to and as provided in the Improvement Act of 1911, Division 7 of the Streets and Highways Code of the State of California. Section 8. The said proposed work is to be done under and proceedings therefore are to be under and pursuant to the said Improvement Act of 1911. Section 9. Notice is hereby given that the 3rd day ofJune, 1969, at the hour of 8:00 o'clock P.M. are the day and hour when, and the Council Chambers of this City Council in the Civic Center in the City of National City is the place where, any and all persons having any protest or objection to said proposed work or to the extent of said assessment district, or to the pro- posed grades, may appear before the City Council of the City of National City and show cause why said proposed work should not be carried out in accordance with the Resolution of Intention. Protests or objections must be in writing and must be delivered to the City Clerk of said City of National City not later than the hour herein set for hearing protests or objections. Section 10. The National City Star News is hereby selected as the newspaper in which this resolution shall be published and in which all other publications regarding the proceedings pursuant to this Resolution of Intention shall be made. The City Clerk is hereby directed to certify to the adoption of this Resolution and to cause said Resolution to be published in the manner pro- vided by law. Section 11. The City Clerk is hereby directed to mail notices of the adoption of this resolution as provided in said Improvement Act of 1911, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the cost of said work whose names and addresses appear on the last equalized assessment roll or as known to the City Clerk. Section 12. The Street Superintendent of the City of National City is hereby directed to cause to be conspicuously posted along the line of the con- templated work and on all open streets within the said assessment district notices of the passage of this Resolution of Intention in the time, form and manner provided by law. NO. 9804 (27th Street and "A" Avenue Assessment District No. 163) ' NOTICE IS HERESY GIVEN that on April 22, 1g69, the City Council of the City of National City, passed and adopted Resolution of Intention No. 9304 under the provisions of the Improvement Act of 1911 for the purpose of ordering the following work to be done and improvements to be made in the City of ,National City, County of San Diego, State of California, to wit: That 27th STREET AND "A" AVENUE, ASSESSMENT DISTRICT NO. 163 be improved as follows: earthwork, curb, paving and that any other wort.: auxiliary to -any of the above and which may be required to carry out the same., be performed, except- ing therefrom all of the herein -described work of all said work that has already been done to the lines and grades and in accordance with the plans, specifica- tions and drawings hereafter described. The estimated cost of the construction of said improvements is the sum of $22,075.72, including. incidental expenses. The City of National City has budgeted the sum of $4,074.69 as a contribution toward the cost of said work. The remaining costs thereof will be assessed upon the property benefited. According to the last equalized roll for taxes you are the owner of property within the boundaries of the district which will be assessed to pay the costs and expenses of this improvement. Said Resolution of Intention No. 9804 is on file in the office of the City Clerk of the City of National City and is referred to for all particulars. NOTICE IS HERESY GIVEN THAT ON: June 3, 1969, at the hour of 8:00 p.m. of said day, at the meeting place of the City Council of the City of National City, 1243 National Avenue, National City, California has been fixed as the time and place of hearing any and all objections to the proposed work and improvement, the grades to which said work is proposed to be done or the boundaries of the district. Any persons owning property within the boundaries of the district may present written protest, not later than the hour hexeinabove set for hearing, against the doing of said work, the grades to which said work is to be done or the boundaries of the district pro- posed to be assessed. Any protest filed must -be in writing and must contain a description of the prope•ty in which the signer thereof is interested, suffic- ient to identify the same, and must be delivered to the City Clerk of the City of National City. This work is to be done by special assessment proceedings under the Improve- ment Act of 1911. Property owners will be able to pay their assessments in cash at the termination of work and confirmation of the assessment. If any property owner does not desire to pay for the work in cash, a bond will be issued against the property for the amount of any assessment of $50.00 or more, under the Improvement Act of 1911, which bond will bear interest at the rate of six percent (6%) per annum and will be payable in equal installments over a period of nine (9) years.
