'9829 RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT FOR IMPROVEMENT OF PARADISE VALLEY ROAD BE .IT RESOLVED. by the City Council of the City of National City that .the Mayor and City Clerk are authorized to execute and attest that certain Agreement for 'Improvement of Paradise Valley Road between the City of National City, .the City of San Diego, and the County of San Diego. PASSED AND ADOPTED this 20th day of May, 1969. 4-2LE CITY.CLE AGREEMENT FOR THE IMPROVEMENT OF PARADISE VALLEY ROAD 1969, by and between the CITY OF NATIONAL CITY, a municipal corporation, hereinafter called National City; the CITY OF SAN DIEGO, a municipal corporation, hereinafter called San Diego; and the COUNTY OF SAN DIEGO, a political subdivision of the State of California, hereinafter called the County. W ITNESSETH: WHEREAS, National City, San Diego, and the County desire to enter into a joint cooperative agreement to improve Paradise Valley Road to a four -lane paved roadway from the intersection of Eighth.Street and Plaza Boulevard in the City of National, through the County, to the presently improved widened, section near Briarwood Road in the City of San Diego, a distance of approximately 2.1 miles, and WHEREAS, National City, San Diego, and the County desire to proceed with the construction of said improvements and to share in the cost of such construction. - NOW THEREFORE, IT IS MUTUALLY AGREED by and between National City, San Diego, - and the County as follows: 1. National City, San Diego, and the County shall cause to be improved by widening to a four —lane, paved roadway that portion of Paradise Valley Road from the intersection of Eighth Street and Plaza in the City of National City to approximately Briarwood Road in the City of San Diego, a distance of approximately 2.1 miles. 2. That in general the distribution of the work and the responsibility therefor is as follows: a. That San Diego will design and prepare plans and specifications for the road improvement project which will include a traffic signal at the intersection of Paradise Valley. Road with Eighth Street and Plaza Boulevard. b. That San Diego will provide all Inspection and contract management c. That San Diego will perform all materials engineering necessary to_ determine a suitable structural section and furnish control testing during the construction of the project. All costs incurred by San Diego for preliminary engineering, design, and construction engineering expense, inspection and contract management services shall be shared by National City, San Diego, and the County based on the percentage of construction costs of the roadway within its jurisdiction as shown on Exhibit A. The engineering and construction cost of the traffic signal shall be paid by National City and the County only with National City paying two-thirds (2/3) of the cost and the County one-third (1/3) of the cost. Such percentages of the roadway or traffic signal shall not be altered by annexation subsequent to the execution of this agreement. In the event right of way must be purchased or condemned it will be the responsibility of the agency in whose jurisdiction the property is located to acquire the necessary right'of way within its jurisdiction; provided, however, that National City and/or San Diego respectively shall reimburse the County for necessary right of way purchased or condemned by the County which is part of a parcel of real property presently within the County's jurisdiction if the parcel has been annexed to National City and/or San Diego prior to acquisition as evidenced by the recordation of a final order of condemnation, grant deed, or deed of easement for such right of way. • 4. After bids for any improvement have been received and opened by San Diego and prior to the award of any contract for said improvement by San Diego, San Diego shall notify National City and the County of the lowest responsible bid thereof. If either National City or the County wishes to reject for cause the award of the contract in accordance with the lowest responsible bid, San Diego shall reject all bids and advertise for new bids based either on existing contract documents or based on revised plans and specifications. If the contract cannot be awarded, National City and the County will reimburse San Diegofor their share of engineering.. San Diego will furnish National City and the County each a reproducible set of plans and specifications for its respective use. 5. After approval bidder but prior to the separately deposit with by National. City and the County of the responsible low award:of contract, National City and the County shall San Diego One Hundred and Twenty Percent (120%) of the estimated total cost of construction of said improvement computed on the basis of unit prices bid within their jurisdictions according to Exhibit A and their proportionate share of the traffic signal. Such proportionate share shall not be altered, by annexation subsequent to the execution of this agreement. Money so deposited will be applied to each jurisdiction's share of the project cost. excess money deposited with San Diego shall be returned after the project is can- pleted and financial accounts are closed. If National City's and/or the County's share is more than the amount originally deposited, National City and/or the County shall pay San Diego the difference. Final payment is due and pay able upon receipt of a bill from San Diego to National City and/or the County. 6. The plans and specifications for this improvement shall be approved by the City Engineers on behalf of the respective cities and by the County Engineer on behalf of the County. IN WITNESS WHEREOF this AGREEMENT is executed by the County of San Diego by action taken by its Board of Supervisors, by the City of National City by action taken by its City Council, and by the City of San Diego by action taken by the City Council RECOMMENDED: D.
