HomeMy WebLinkAboutCC RESO 9689RESOLUTION NO. 9689 RESOLUTION OF INTENTION (8th Street, "k" Avenue to Easterly Line of Railway Right -of -Way, Assessment District No. 165) The City Council of the City of National City, California, does hereby resolve, determine and order as fol- lows: Section 1. The public interest and convenience re- quire and it is the intention of the City Council of said City of National City to order the following work to be done or improvement to be made in the City of National City, to wit: that 8TH STREET, "R" AVENUE TO EASTERLY LINE OF RAILWAY RIGHT-OF-WAY, ASSESSMENT DISTRICT NO. 165 be improved as fol- lows: reconstruction of the street by the removal of con- crete and the construction of curbs, A.C. paving and other work auxiliary to any of the above and which may be required to carry out the same, be performed. Section 2. The attention of all persons is directed to the fact that all of said classes of work above described may not be constructed upon all of the streets or public ways above mentioned in their entirety, but only upon the parti- cular locations shown on the plans, specifications and draw- ings. Section 3. The estimated cost of said work, in- cluding incidental expenses, is the sum of $169,188.30. The City has budgeted the sum of $112,000.00 as a contribution to said cost. Section 4. All the aforesaid work or improvement shall be constructed at the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, specifications, profiles and drawings for the said work approved and adopted by this Council on October 29, 1968 by Resolution No. 9688 Said plans, specifications, profiles and drawings are on file in the office of the City Clerk of the City of National City in the Civic Center of said City, and reference is hereby made to said plans, specifications, profiles and drawings for a full and detailed description of said proposed work and for a description of the grades at which said work is to be done. Said grades are hereby adopted and established as the official grades for all purposes in connect- ion with proceedings pursuant to this Resolution of Intention. Notice is hereby given that said grades may be new and differ- ent from those heretofore established or existing, or may be, and in some cases are, different from existing ground levels. Section 5. This City Council hereby makes the ex- pense of said work chargeable upon a district, which district this City Council hereby declares to be the district benefited by the said work and to be assessed to pay the cost and ex- penses thereof. For a description of said district, reference is hereby made to a map of said district heretofore approved by this City Council on file in the office of the City Clerk and designated as "MAP OF ASSESSMENT DISTRICT NUMBER 165, ALL IN THE CITY OF NATIONAL CITY, CALIFORNIA". This map indicates by a boundary line theextent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. Section 6. All public streets or public parks, and all easements or rights of way belonging to the public, and also all property owned by the United States of America or the State of California now in use in the performance of a public function are hereby specifically excluded from this assessment district. Section 7. Serial bonds bearing interest at the rate of six percent (6%) per annum shall be issued to represent each assessment of fifty dollars ($50.00) or over remaining un- paid for thirty (30) days after the date of recordation of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September 1 following their date. Said bonds shall be payable to bearer and there shall be added after the redemp- tion clause in the bond the following language, "together with a Premium of five percent (5%) of said unmatured principal." Said bonds are to be issued pursuant to and as provided in the Improvement Act of 1911, Division 7 of the Streets and Highways Code of the State of California. In the event of a delinquency of said bond, the City Treasurer shall retain the first one percent (1%) penalty as a cost of servicing the delinquency. All subsequent penalties shall be paid to the holder of the bond along with and as a part of such defaulted payment. Section 8. The said proposed work is to be done under and proceedings therefore are to be under and pursuant to the said Improvement Act of 1911. Section 9. Notice is hereby given that the 3rd day of December, 1968, at the hour of 8:00 o'clock p.m. are the day and hour when, and the Council Chambers of this City Council in the Civic Center in the City of National City is the place where, any and all persons having any protest or objection to said proposed work or to the extent of said assessment dis- trict, or to the proposed grades,may appear before the City Council of the City of National City and show cause why said proposed work should not be carried out in accordance with this Resolution of Intention. Protests or objections must be in writing and must be delivered to the City Clerk of said City of National City not later than the hour herein set for hearing protests or objections. Section 10. The report of the City algineer pur- suant to the provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 is on file with the City Clerk of National City and may be examined in her office. Section 11. The National City Star News is hereby selected as the newspaper in which this resolution shall be published and in which all other publications regarding the proceedings pursuant to this Resolution of Intention shall be made. The City Clerk is hereby directed to certify to the adoption of this Resolution and to cause said Resolution to be published in the manner provided by law. Section 12. The City Clerk is hereby directed to mail notices of the adoption of this resolution as provided in said Improvement Act of 1911, postage prepaid, to all per- sons owning real property which is proposed to be assessed to pay any part of the cost of said work whose names and addresses appear on the last equalized assessment rollor as known to the City Clerk. Section 13. The Street Superintendent of the City of National City is hereby directed to cause to be conspicuous- ly posted along the line of the contemplated work and on all open streets within the said assessment district notices of the passage of this Resolution of Intention in the time, form and manner provided by law. ATTEST: NOTICE OF IN FROVENENT (8th-Street, "K" Avenue to Easterly Line of Railway Right -of -Way, Assessment District No.:165) NOTICE IS HEREBY GIVEN that on October 29. 1968 , the City Council of the City of National City, passed and adopted Resolution of Intention No. 9689 under the provisions of the Improvement Act of 1911 for the purpose of ordering the following work to be done and improvements to be made in the City of National City, County of San Diego, State of California, to wit: That 8th Street, „KI1 Avenue Right -of -Way, Assessment District follows: earthwork, curb, paving to any of the above and which may be performed, excepting therefrom of all said work that has already and in accordance with the plans, after described. to Easterly Line of Railway No 16C be improved as and that any other work auxiliary be required to carry out the same, all of the herein -described work been done to the lines and grades specifications and drawings here - The estimated cost of the construction of said improvements is the sum of $ 169,188.30 , including incidential,expenses. The City of National City has budgeted the sum of $ 112,000.00 as a contribution toward the cost of said work. The remaining costs thereof will he assessed upon the property benefited. According to the last equalized roll for taxes you are the owner of property within the boundaries of the district which will be assessed to pay the costs and expenses of this improvement. Said Resolution of In- tention No. 9689 is on file in the office of the City Clerk of the City of National City and is referred to for all particulars. NOTICE IS HEREBY GIVEN THAT ON: December 3, 1968 , at the hour of 8:00 p.m. of said day, at the meeting place of the City Council of the City of National City, 1243 National Avenue, National City, California has been fixed as the time and place of hearing any and all objections to the proposed work and improvement, the grades to which said work is proposed to be done, or the boundaries of the district. Any persons owning prop- erty within the boundaries of the district may present written pro- test, not later than the hour hereinabove set for hearing; against the doing of said work, the grades to which said work is to be done or the boundaries of the district proposed to be assessed. Any pro- test filed must be in writing and must contain a description of the property in which the signer thereof is interested, sufficient to identify the same, and must be delivered to the City Clerk of the City of National City. This work is to be done by special'assessment proceedings under the Improvement Act of 1911. Property owners will be able to pay their assessments in cash at the termination of work and confirmation of the assessment. If any property owner does not desire to pay fox the work in cash, a bond will he issued against the property for the amount of any assessment of $50.00 or more, under the Improvement Act of 1911, which bond will bear interest at the rate of six percent (6%) per annum and will be payable in equal installments over a period of nine (9) years.
