RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962

The City Council of the City of National City does
hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary hardship,
and a result inconsistent with the general purpose and intent of
Ordinance No. 962 would occur through strict application of the
provisions of said Ordinance to that certain real property
hereinafter described.
2. That a Petition requesting a variance has been
filed pursuant to the provisions of Section 12 of said Ordinance
and said Petition complies with all the requirements of said
section.
3. That the National City Planning Commission did
hold a hearing on said Petition and did recommend to the City
Council that a variance be granted.
4. That the granting of a variance with reference to
the property hereinafter described will not defeat, but rather
will carry out the general intent and purpose of the National
City Zoning Ordinance, will provide for the public safety and
welfare and will administer substantial justice.
5. That a variance from the provisions of said
Ordinance No. 962 be and hereby is granted with reference to
all the certain real property situated in the City of National
City, California, more particularly described as follows:
Property located between A Avenue and S Avenue
extention, between 22nd Street and 24th Street,
from the required five (5') foot setback on all
fence installations and landscaped areas bordering
a dedicated street and abutting residential property
to the east to a zero (0') foot setback.
6. That variance be granted from the required five
(5') foot setback to a zero (0') foot setback on all four sides
of subject property, subject to the following conditions:
a. Area Between the fence and the curb on
24th Street be improved with concrete in accordance
with City of National City Engineering datum.
b. Curbs, gutters and sidewalk to be installed
on 22nd Street and A Avenue between 22nd Street and
24th Street.
c. Property owners to install and maintain
shrubs and/or trees between the property line and
the sidewalk on 22nd Street and on A Avenue between
22nd Street and 24th Street. All portions of the
parkways not included within driveways or sidewalks
shall be landscaped.
d. All areas utilized for parking or standing
of automobiles shall be surfaced with a minimum of
two inches of asphaltic concrete or equivalent.
e. All improvements are to be completed within
one hundred and twenty (120) days of approval of
subject variance by the City Council.
f. Said variance shall be subject to review by
the Planning Commission on any future development and
on construction of permanent structures.
This variance is granted to allow the storage of
automobiles on the subject premises. Any other use of the
subject premises will result in the immediate automatic
termination of this variance.
