RESOLUTION AMENDING RESOLUTION OF INTENTION NO. 9634

The Resolution of Intention, Resolution No. 9634,
heretofore adopted by the City Council of the City of National
City on August 6, 1968 is amended to read as follows:
The City Council of the City of National City, Calif-
ornia, does hereby resolve, determine and order as follows:
Section 1. The public interest and convenience re-
quire and it is the intention of the City Council of said
City of National City to order the following work to be done
or improvement to be made in the City of National City, to
wit: that "I", "J", "L", 20TH, 22ND, 24TH STREETS, ASSESS-
MENT DISTRICT NO. 153 be improved as follows: earthwork,
curb, paving and miscellaneous items as shown on the plans
or that are necessary for the completion of the work and that
any other work auxiliary to any of the above and which may be
required to carry out the same, be performed.
Section 2. The attention of all persons is directed
to the fact that all of said classes of work above described
may not be constructed upon all of the streets or public ways
above mentioned in their entirety, but only upon the particular
locations shown on the plans, specifications and drawings.
Section 3. The estimated cost of said work includ-
ing incidential expenses, is the sum of $94,483.16. The City
has budgeted the su.m of $21,225.00 as a contribution to said
cost.
Section 4. All the aforesaid work or improvement
shall be constructed at the grades, along the lines, between
the points, of the dimensions, at the places and in the manner
shown on the plans, specifications, profiles and drawings for
the said work approved and adopted by this Council on May 28,
1968 by Resolution No. 9606. Said plans, specifications, pro-
files and drawings are on file in the office of the City Clerk
of the City of National City in the Civic Center of said City,
and reference is hereby made to said plans, specifications,
profiles and drawings for a full and detailed description of
said proposed work and for a description of the grades at which
said work is to be done. Sid grades are hereby adopted and
established as the official grades for all purposes in con-
nection with proceedings pursuant to this Resolution of In-
tention. Notice is hereby given that said grades may be new
and different from those heretofore established or existing,
or may be, and in some cases are, different from existing
ground levels.
Section 5. This City Council hereby makes the ex-
pense of said work chargeable upon a district, which district
this City Council hereby declares to be the district benefited
by the said work and to be assessed to pay the cost and expenses
thereof. For a description of said district, reference is here-
by made to amended map of said district heretofore approved by
this City Council on file in the office of the City Clerk and
designated as "AMENDED MAP OF ASSESSMENT DISTRICT NO. 153, ALL
IN THE CITY OF NATIONAL CITY, CALIFORNIA", County Recorder's
File No. 125956. This map indicates by a boundary line the ex-
tent of the territory included in the said proposed district
and shall govern for all details as to the extent of said assess-
ment district.
Section 6. All public streets or public parks, and
all easements or rights of way belonging to the public, and
also all property owned by the United States of America or the
State of California now in use in the performance of a public
function are hereby specifically excluded from this assessment
district.
Section 7. Serial bonds bearing interest at the
rate of six percent (6%) per annum shall be issued to repre-
sent each assessment of fifty dollars ($50.00) or over remain-
ing unpaid for thirty (30) days after the date of recordation
of the warrant. Said serial bonds shall extend over a period
ending nine (9) years from the second day of January next
succeeding the next September 1 following their date. Said
bonds shall be payable to bearer and there shall be added
after the redemption clause in the bond the following language,
"together with a premium of five percent (5%) of said unmatured
principal." Said bonds are to be issued pursuant to and as
provided in the Improvement Act of 1911, Division 7 of the
Streets and Highways Code of the State of California.
In the event of a delinquency of said bond, the City
Treasurer shall retain the first one percent (1%) penalty as a
cost of servicing the delinquency. All subsequent penalties
shall be paid to the holder of the bond along with and as a
part of such defaulted payment.
Section 8. The said proposed work is to be done
under and proceedings therefore are to be under and pursuant
to the said Improvement Act of 1911.
Section 9. Notice is hereby given that the loth day
of September, 1968, at the hour of 8:00 o'clock p.m. are the
day and hour when, and the Council Chambers of this City Coun-
cil in the Civic Center in the City of National City is the
place where, any and all persons having any protest or object-
ion to said proposed work or to the extent of said assessment
district, or to the proposed grades, may appear before the
City Council of the City of National City and show cause why
said proposed work should not be carried out in accordance
with this Resolution of Intention. Protests or objections
must be in writing and must be delivered to the City Clerk of
said City of National City not later than the hour herein set
for hearing protests or objections.
Section 10. The report of the City Engineer pur-
suant to the provisions of the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 is on file with the
City Clerk of National City and may be examined in her office.
Section 11. The National City Star News is hereby
selected as the newspaper in which this resolution shall be
published and in which all other publications regarding the
proceedings pursuant to this Resolution of Intention shall big
made. The City Clerk is hereby directed to certify to the
adoption of this Resolution and to cause said Resolution to
be published in the manner provided by law.
Section 12. The City Clerk is hereby directed to
mail notices of the adoption of this resolution as provided in
said Improvement Act of 1911, postage prepaid, to all persons
owning real property which is proposed to be assessed to pay
any part of the cost of said work whose names and addresses
appear on the last equalized assessment roll or as known to
the City Clerk.
Section 13. The street Superintendent of the City
of National City is hereby directed to cause to be conspicuously
posted along the line of the contemplated work and on all open
streets within the said assessment district notices of the
passage of this Resolution of Intention in the time, form and
manner provided by law.

ASSESSMENT DISTRICT NO. 153)
NOTICE IS HEREBY GIVEN that on August 6, 1968, the City Council
of the City of National City, passed and adopted Resolution of
Intention No. 9634 (amended by Resolution No. 9647, adopted August 13,
1968) under the provisions of the Improvement Act of 1911 for the
purpose of ordering the following work to be done and improvements to
be made in the City of National City, County of San Diego, State of
California, to wit:
That I, J, L 20TH, 22ND, 24TH STREETS, ASSESSMENT DISTRICT NO.
153 be improved as follows: earthwork, curb, paving and that any other
work auxiliary to any of the above and which may be required to carry
out the same, be performed, excepting therefrom all of the herein -
described work of all said work that has already been done to the lines
and grades and in accordance with the plans, specifications and drawings
hereafter described.
The estimated cost of the construction of said improvements is the
sum of $94 483.16, including incidental expenses. The City of National
City has budgeted the sum of $21,225.00 as a. contribution toward the
cost of said work. The remaining costs thereof will be assessed upon
the property benefited. According to the last equalized roll for taxes
you are the owner of property within the boundaries of the district
which will be assessed to pay the costs and expenses of this improvement.
Said Resolution of Intention No. 9634 and amending Resolution 9647 are
on file in the office of the City Clerk of the City of National City and
are referred to for all particulars.
NOTICE IS HEREBY GIVEN THAT ON:
September 10? 1968, at the hour of 8:00 p.m. of said day, at the
meeting place of the City Council of the City of National City, 1243
National Avenue, National City, California has been fixed as the time
and place of hearing any and all objections to the proposed work and
improvement, the grades to which said work is proposed to be done, or
the boundaries of the district. Any persons owning property within
the boundaries of the district may present written protest, not later
than the hour hereinabove set for hearing, against the doing of said
work, the grades to which said work is to be done or the boundaries
of the district proposed to be assessed. Any protest filed must be in
writing and must contain a description of the property in which the
signer thereof is interested, sufficient to identify the same, and must
be delivered to the City Clerk of the City of National City.
This work is to be done by special assessment proceedings under
the Improvement Act of 1911. Property owners will be able to pay their
assessments in cash at the termination of work and confirmation of the
assessment. If any property owner does net desire to pay for the work
in cash, a bond will be issued against the property for the amount of
any assessment of $50.00 or more, under the Improvement Act of 1911,
which bond will bear interest at the rate of six percent (6%) per annum
and will be payable in equal installments over a period of nine (9)
years.

NOTICE IS HEREBY GIVEN that on August 6, 1968, the City Council
