HomeMy WebLinkAboutCC RESO 9517RESOLUTION NO. 9517 A RESOLUTION APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "BRITTON ANNEXATION" TO THE CITY OF NATIONAL CITY (CALIFORNIA GOVERNMENT CODE SECTION 35310.1) WHEREAS, on the 7th day of November, 1967, the Council of the City of National City did pass and adopt Res- olution No. 9486 giving notice of the proposal to annex cer- tain uninhabited territory to the City of National City, said territory being therein designated as "BRIr1UN ANNEXATION", and said Resolution did describe the boundaries of the ter- ritory proposed to be annexed, and WHEREAS, said Resolution No. 9486 did contain a notice of the day, hour and place when and where the Council of the City of National City would hear protests, the time of said hearing being not more than 30 days from the time of passage of said Resolution, and WHEREAS, on the 19th day of December, 1967, at the hour of 8:00 p.m. in the Council Chambers in the Civic Center of the City of National City, County of San ;Diego, State of California, said time and place being the day, hour and place fixed in said Resolution No. 9486 for hearing protests to the said annexation, the said City Council did bear and pass on all protests made to the proposed annexation and did deter- mine that all protests, if any, be overruled, and WHEREAS, the petition filed with the City Council was signed by the owners of all of the land in the territory proposed to be annexed and said Resolution No. 9486 declared the fact and all other requirements of Government Code Section 35310.1 have been fully satisfied; and WHEREAS, said territory is contiguous to the City of National City, and is uninhabited territory in the County of San Diego; NOW, THEREFORE, the City Council of the City of National City, does resolve as follows: SECTION 1: The City Council of the City of National City does hereby approve the annexation ofthe territory here- inafter described to the City of National City, and does here- by further resolve that the said territory be and is hereby annexed to the City of National City, subject to the following conditions: A. The "Right of Protest" to the proposed 1911 Act Improvement on 24th Street be waived by the property owners within subject annexation; B. The City of National City declines guarantee to the property owners within subject annexation, that said property will be served by existing sewer facilities within 24th Street; C. The costs of any and all special apparatus, if used to adequately utilize the existing sewer facilities in 24th Street be borne by the property owner; D. Subject territory be withdrawn from the Lower Sweetwater Local Fire District and the San Diego County Flood Control District. That said territory, the annexation of which to the City of National City is herein approved, is all that territory situated in the County of San Diego, State of California, more particularly described as follows: Beginning at the Northwesterly corner of Lot No. 436, Lincoln Acres Annex No. 3, according to Map thereof No. 1754 on file in the San Diego County Recorderts Office; thence Easterly along the Northerly line of said Lot, 59 feet more or less to the Northeasterly corner of said Lot 436; then Southerly along the Easterly line of said Lot 436, 102 feet; thence Westerly parallel with the Northerly line of said Lot 436 a distance of 59 feet, more or less, to a point on the Westerly line of said Lot 436, said point being 102 feet measured Southerly along the Westerly line of said Lot 436 from the Northwesterly corner thereof; thence Northerly along the Westerly line of said Lot 436, 102 feet to the Point of Beginning.
