HomeMy WebLinkAboutCC RESO 9522RESOLUTION NO. 9.522 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE SAN DIEGO COUNTY PLANNING COMMISSION AND CITY OF NATIONAL CITY 10 CONDUCT THE CENSUS METROPOLITAN MAPPING AND ADDRESS CODING GUIDE PROGRAM BE IT RESOLVED by the City Council of the City of National City, California that the City Manager and City Clerk are authorized to execute and attest that certain Agreement between the San Diego County Planning Commission and the City of National City to conduct a Cencus Metropolitan Mapping and Address Coding Guide Program within the incorporated limits, a copy of which is attached hereto. ATTEST: COUNTY CONTRACT NO. 4047 (9)-4900-E/R AGREEMENT BETWEEN THE SAN DIEGO COUNTY PLANNING COMMISSION AND THE CITY OF NATIONAL CITY TO CONDUCT A CENSUS METROPOLITAN MAPPING AND ADDRESS CODING GUIDE PROGRAM WITHIN THE INCORPORATED LIMITS THIS AGREEMENT entered into as of this day of 1968, by and between the San Diego County Planning Commission (herein called the "County") and the City of National City (herein called the "City"). WITNESSETH THAT: WHEREAS, the City desires to engage the County to render through its Planning Department certain technical and professional services hereinafter described in connection with an undertaking of the City which is expected to be partially financed under Section 701 of the Housing Act of 1954, as amended: NOW, THEREFORE, the parties hereto do mutually agree as follows: 1. Employment of County Personnel. The City hereby engages the County and the County hereby agrees to perform the services hereinafter set forth in connection with the Census Metropolitan Mapping and Address Coding Guide Program under the County's Urban Planning Grant Contract P-283. 2. Area Covered. The County shall perform all the necessary services provided under this Contract in connection with and respecting all of the area of the City incorporated as of the date of this Contract. 3. Scope of Services. The County shall do, perform, and carry out, in a satisfactory and proper manner, the following services: a. The County shall conduct the Census Metropolitan Mapping and Address Coding Guide Program in accordance with Appendix 2, Bureau of Census "Guidelines and Responsibilities of Coordinating Agency for the Metropolitan Mapping and Address Coding Guide Program", dated January 1, 1967. b The' Mapping and Address Coding Guide Program will be accomplished in the following manner: (1) The County will act as the Coordinating agency. (2) The County will assign on a temporary basis the appropriate staff to assist the City in checking maps and the work sheets for the address coding guides. (3) All supervision and materials of the program will be provided by the County. (4) Upon completion of the Program the applicable 1" = 800' Census Metropolitan Maps with completed data will be furnishedto the City. 4. Data and Services to be Furnished to County. A11 staff assistance, information, data, reports, records and maps as are existing, available, and necessary for the carrying out of the work shall be furnished to the County without charge by the City. The City shall cooperate with the County in every way possible in carrying out the map review and preparation of the work sheets for the Address Coding Guide. 5. Personnel. a. The County represents that it has, or will secure at its own expense, all personnel required in performing the services under this Contract. Such.personnel shall not be employees of or have any contractual relationship with the City. b. All of the services required hereunder will be performed by the County or under its supervision, and all personnel engaged in the work shall be fully qualified and shall be authorized under State and local law to perform such services. c. None of the work or services covered by this Contract shall be sub- contracted. 6. Time of Performance. The services of the County are to commence as soon as practicable after the execution of this Contract and shall be under- taken and completed in such sequence as to assure their expeditious completion in the light of the purposes of this Contract, but in any event all of the services required hereunder shall be completed by December 11, 1969. 7. Compensation. The City agrees to provide staff services to the County of a minimum value of $214, and may provide more. Said amount includes all costs for staff salaries and related direct costs. 8. Method of Payment. The City will submit an approved time card to the County Planning Department verifying that the amount of services contributed by the City is equivalent to said minimum of $214. 9. Nondiscrimination. There shall be no discrimination against any employee who is employed in the work covered by this Contract, or against any applicant for such employment, because of race, religion, color or national origin. This provision shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensa- tion; and selection for training, including apprenticeship. 10. Interest of Members of City and Others. No officer, member, or employee of the City and no member of its governing body, and no other public official of the governing body of the locality or localities in which the Project is situated or being carried out who exercises any functions or responsibilities in the review or approval of the undertaking or carrying out of this Project, shall (a) participate in any decision relating to this -2- Contract which affects his personal interest or the interest of any corporation, partnership or association in which he is, directly or.indirectly, interested; or (b) have any interest, direct or indirect, in this Contract or the proceeds thereof. 11. Assignability. The County shall not assign any interest in this Contract, and shall not transfer any interest in the same (whether by assignment or novation), without the prior written consent of the City hereto. 12. Officials Not to Benefit. No Member of or Delegate to the Congress of the United States of America, and no Resident Councilman, shall be admitted to any share or part thereof or to any benefit to arise herefrom.
