RESOLUTION AUTHORIZING EXECUTION OF LEASE AGREEMENT
WITH THE SAN DIEGO UNIFIED SCHOOL DISTRICT
BE IT RESOLVED by the City Council of the City of
National City that the Mayor is authorized to execute that
certain Lease Agreement between the City of National City
and the San Diego Unified School District for use of the
swimming facilities at the municipal plunge.
PASSED AND ADOPTED this 6th day of February,

LEASE AGREEMENT
THIS LEASE AGREEMENT, made and entered into this t day of
by and between CITY OF NATIONAL CITY, hereinafter
called "City," and the SAN DIEGO UNIFIED SCHOOL DISTRICT OF SAN DIEGO COUNTY,
CALIFORNIA, hereinafter called "District," WITNESSETH:
WHEREAS, City has swimming facilities available for use and desires
to assist District in making said facilities available to students of Morse
High School for interscholastic swimming; and
WHEREAS, District is desirous of utilizing said facilities, and it
is to the mutual benefit of the parties hereto that said facilities be so
used as aforesaid; NOW, THEREFORE,

For and in consideration of the mutual promises, covenants, and
agreements hereinafter set forth and the payment of the rent herein provided,
the parties hereto agree as follows:
1. City shall make available to District swimming facilities,
including swimming pool and shower and locker facilities at Las Palmas
Municipal Pool, during the hours of 4:00 to 5:30 p.m., Monday through
Thursday, on regular school days.
2. The term of this lease agreement shall be from February 19,
1968 to May 24, 1968 inclusive; provided, however, that this lease may be
terminated at any time by either party upon thirty (30) days' written notice.
3. District agrees to pay City the sum of Seven Hundred Sixty-five
and no/100 Dollars ($765.00) for the use of the facilities. Payment shall
be made at the end of the period herein specified and upon receipt of an
invoice for same in triplicate.
4. City agrees to furnish pool and shower and locker facilities
for each student using said facilities; District or students agree to furnish
soap and towels.
5. District agrees to furnish City with a roster of team member-
ship and to keep such list current. In addition, each authorized team member
shall carry an identification card issued by said District.
6. The students shall be under the supervision and control of at
least one certificated employee of District while using said facilities, and
shall at all times conduct themselves in accordance with the highest standards
of conduct established by their respective schools.
7. District, so far as it may lawfully do so, shall hold City harm-
less from any and all liability for injury to person or damage to property
arising directly or indirectly from any act or omission of any employee or
officer of said District or any person occupying the demised facilities under
or pursuant to this agreement.
8. District agrees to pay for all items of major breakage incurred
by and through its use of said premises; i.e., breakage of equipment or facili-
ties not included within normal wear and tear.
9. It is understood and agreed that this agreement shall not pre-
clude the use of the swimming facilities by students who might otherwise do so
under the auspices of the City Recreation Department in addition to the
scheduled times herein shown.
10. District's use of City facilities shall be limited to those
listed in Paragraph 1 above.
IN WITNESS WHEREOF this lease agreement has been executed by the City
of National City, acting by and through its Mayor, pursuant to Resolution
No. VS3if , authorizing such execution, and by the San Diego Unified
School District of San Diego County,
