HomeMy WebLinkAboutCC RESO 9539RESOLUTION NO. 9539 RESOLUTION GRANTING SPECIAL USE PERMIT PURSUANT TO ORDINANCE NO. 962 (Moynahan Towing Service) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That a request for a Special Use Permit, pur- suant to the provisions of Section 8, paragraph I, 2, has been submitted to the Planning Commission, and said Commission at a regular meeting has recommended granting said Special Use Per- mit upon certain conditions. 2. That the granting of said Special Use Permit, subject to the conditions hereinafter specified, will, in the opinion of the City Council, protect the public health, safety and general welfare. 3. That a Special Use Permit is hereby granted with reference to all the certain real property situated in the City of National City, California, more particularly des- cribed as follows: All those portions of Lots 13 throu.gh 22 inclu.sive of Block 165; of Lots 1 through 10 inclusive of Block 156 and of the Southerly Half of Twenty-seventh Street, the Northerly Half of Twenty-eighth Street, vacated and closed to public use, except the Southerly 30.00 feet thereof; and of Wilson Avenue (Formerly Fifth Avenue), vacated and closed to public use, all in National City Plat in the City of National City, County of San Diego, State of California according to the Map thereof No. 348 filed in the office of the County Recorder of said San Diego County, October 2, 1882, more particularly described as follows: Commencing at the Northwesterly corner of Bahia Vista according to the Map thereof No. 1815, filed in the office of the County Recorder of said San; Diego County, December 19, 1924; thence Northerly along the centerline of the alley in Block 165 of said NationalCity Plat according to the Map thereof No. 348, a distance of 30.00 feet; thence Easterly along a line parallel with and 30.00 feet Northerly, measured at right angles, to the Northerly line of said Bahia Vista a distance of 119.97 feet to the beginning of a 40.00 foot radius curve concave North- easterly and the TRUE POINT OF BEGINNING; thence Westerly and Northerly along the arc of said curve to its tangent intersect- ion with a line parallel with and 80.00 feet, measured at right angles, to said centerline of the alley in Block 165 of National City Plat; thence Northwesterly along said parallel line to the centerline of Twenty-seventh Street as shown on said Map No. 348, vacated and closed to public use; thence Northeasterly along said centerline of Twenty-seventh Street a distance of 218.75 feet; thence leaving said centerline of Twenty-seventh Street Southeasterly along a line parallel with said center line of the alley in Block 165 to its inter- section with said line parallel with and 30.00 feet Northerly, measured at right angles, to said Northerly line of said Bahia Vista; thence Southwesterly along said parallel line to the beginning of the aforestated 40.00 foot radius curve to the TRUE POINT OF BEGINNING. 4. That the Special Use Permit hereby granted to Moynahan Towing Service as a participant in the assignment of service alls on police impounded automobiles, is to store on the property known as 2745 Wilson Avenue, National City, motor vehicles which have been removed from the streets and highways of the City of National City and impounded by the Police ]Depart- ment because they are illegally parked, abandoned, involved within an accident, or obstructing traffic because of mechani- cal failure. 5. That said Special Use Permit is hereby granted upon the following conditions: a. Subject premises be maintained at all times in full compliance with the Zoning Ordinance as amended by Or- dinances No. 1173 and 1182. b. All storage shall be contained within the area shown onthe plot plan as located at the most Northwesterly corner of subject property, within an area not to exceed 50 feet East of the existing fence which is located four feet from the Westerly property line. c. Subject area as shown on the submitted plot plan containing 10,000 gross square feet, encompassing the stor- age area, shall not be enlarged from 200 feet parallel to Wilson Avenue by 50 feet in depth without re -consideration by the City Council with recommendation from the Planning Commission. d. Subject Special Use Permit shall expire upon the termination of an accepted City Contract with the City of National City, or with the cancellation of said Contract with the City of National City. 6. In the event that the City Council should hereafter find and determine that the conditions above set forth have not been satisfied or have been violated, it may declare this; Special Use Permit void and of no further effect.
