RP -SOLUTION OF INTENTION
(27th Street, 29th Street, "C" Avenue,
Assessment District No. 148)
The City Council of the City of National City,
California does hereby resolve, determine and order as fol-
lows:
Section 1. The public interest and convenience re-
cuire and it is the intention of the City Council of said City
of National City to order the following work to be done or im-
provement to be made in the City of National City, to wit:
that 27TH STREET, 29TH STREET, "C" AVENUE, ASSESSMENT DISTRICT
NO. 148 be improved as follows: earthwork, curb, paving and
necessary items to complete the work, be performed.
Section 2. The attention of all persons is directed
to the fact that all of said classes of work above described
may not be constructed upon all of the streets or public ways
above mentioned in their entirety, but only upon the particu-
lar locations shown on the plans, specifications and drawings.
Section 3. The estimated cost of said work, in-
cluding incidental expenses, is the sum of $33,440.96. The
City has budgeted the sum of $2,972.15 as a contribution
toward the cost of said work.
Section 4. All the aforesaid work or improvement
shall be constructed at the grades, along the lines, between
the points of the dimensions, at the places and in the manner
shown on the plans, specifications, profiles and drawings for
the said work approved and adopted by this Council on March
5, 1968, by Resolution No. 9553 Said plans, specifications,
profiles and drawings are on file in the office of the City
Clerk of the City of National City in the Civic Center of said
City, and reference is hereby made to said plans, speci-
fications, profiles and drawings for a full and detailed
description of said proposed work and for a description
of the grades at which said work is to be done. Said grades
are hereby adopted and established as the official grades
for all purposes in connection with proceedings pursuant to
this Resolution of Intention. Notice is hereby given that
said grades may be new and different from those heretofore
established or existing, or may be, and in some cases are,
different from existing ground levels.
Section 5. This City Council hereby makes the
expense of said work chargeable upon a district, which dis-
trict this City Council hereby declares to be the district
benefited by the said work and to be assessed to pay the
cost and expenses thereof. For a description of said dis-
trict, reference is hereby made to a map of said district
heretofore approved by this City Council on file in the of-
fice of the City Clerk and designated as "MAP OF ASSESSMENT
DISTRICT NO. 148" for street improvement on 27th Street, 29th
Street and "C" Avenue. This map indicates by a boundary line
the extent of the territory included in the said proposed dis-
trict and shall govern for all details as to the extent of
said assessment district.
Section 6. All public streets or public parks,
and all easements or rights of way belonging to the public,
and also all property owned by the United States of America
or the State of California now in use in the performance of
a public function are hereby specifically excluded from this
assessment district.
Scction 7. Serial bonds bearing interest at the
rate of six percent (6%) per annum shall be issued to represent
each assessment of fifty dollars ($50.00) or over remaining
unpaid for thirty (30) days after the date of recordation
of the warrant. Said serial bonds shall extend over a
period ending nine (9) years from the second day of January
next succeeding the next September 1 following their date.
Said bonds shall be payable to bearer and there shall be
added after the redemption clause in the bond the following
language, "together with a premium of five percent (5%) of
said unmatured principal." Said bonds are to be issued pur-
suant to and as provided in the Improvement Act of 1911,
Division 7 of the Streets and Highways Code of the State of
California.
In the event of a delinquency of said bond, the
City Treasurer shall retain the first one percent (1%) pen-
alty as a cost of servicing the delinquency. All subsequent
penalties shall be paid to the holder of the bond along with
and as a part of such defaulted payment.
Section 8. The said proposed work is to be done
under and proceedings therefore are to be under and pursuant
to the said Improvement Act of 1911.
Section 9. Notice is hereby given that the 16th
day of April, 1968, at the hour of 8:00 p.m. are the day and
hour when, and the Council Chambers of this City Council in
the Civic Center in the City of National City is the place
where, any and all persons having any protest or objection to
said proposed work or to the extent of said assessment dis-
trict, or to the proposed grades, may appear before the City
Council of the City of National City and show cause why said
proposed work should not be carried out in accordance with
this Resolution of Intention. Protests or objections must
be in writing and must be delivered to the City Clerk of said
City of National City not later than the hour herein set for
hearing protests or objections.
Section 10. The National City Star News is hereby
selected as the newspaper in which this resolution shall be
published and in which all other publications regarding the
proceedings pursuant to this Resolution of Intention shall
be made. The City Clerk is hereby directed to certify to
the adoption of this Resolution and to cause said Resolution
to be published in the manner provided by law.
Section 11. The City Clerk is hereby directed to
mail notices of the adoption of this resolution as provided
in said Improvement Act of 1911, postage prepaid, to all per-
sons owning real property which is proposed to be assessed
to pay any part of the cost of said work whose names and ad-
dresses appear on the last equalized assessment roll or as
known to the City Clerk.
Section 12. The Street Superintendent of the City
of National City is hereby directed to cause to be conspic-
uously posted along the line of the contemplated work and on
all open streets within the said assessment district notices
of the passage of this Resolution of Intention in the time,
form and manner provided by law.
