RESOLUTION ND. 9498
RESOLUTION RANTING ZONE VARIANCE PURSUANT TO
ORDINANCE ND. 962
(Variance in Side and Rear Yard Setback
Requirements - K. M. and V. Nash at
120 Division Street)
The City Council of the City of National City does
hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary hard-
ship, and a result inconsistent with the general purpose and
intent of Ordinance No. 962 would occur through strict
application of the provisions of said Ordinance to that
certain real property hereinafter described.
2. That a Petition requesting a variance has been
filed pursuant to the provisions of Section 12 of said
Ordinance and said Petition complies with all the require-
ments of said section.
3. That the National City Planning Commission did
hold a hearing on said Petition and did recommend to the City
Council that a variance be granted.
4. That the granting of a variance with reference
to the property hereinafter described will not defeat, but
rather will carry out the general intent and purpose of the
National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said
Ordinance No. 962 be and hereby is granted with reference to
all the certain real property situated in the City of
National City, California, more particularly described as
follows:
The Northerly 74.64 feet of the Westerly Half of
Lot 18, Thelem's Resubdivision of a portion of 10
Acre Lot 1, Quarter Section 155, Rancho de la
Nacion, according to Map thereof No. 1233, filed
in the Office of the County Recorder of San Diego
County, February 3, 1910. (120 Division Street,
National City, California)
6. That the variance hereby granted is as follows:
Reduction in rear and interior side yard setback from 4 feet
to 0 feet, subject to the following conditions:
All construction to be in compliance with the 1961
Uniform Building Code as adopted by the City of National City
and all other applicable City Ordinances which would include
a solid masonry wall to be installed on all portions of the
patio constructed upon the property lines.
Variance is granted subject to the installation of
sidewalks on 15th Street prior to final inspection by the
Building Inspector.
PASSED AND ADOPTED this 21st day of November,
1967.
