RESOLUTION GRANTING ZONE VARIANCE
PURSUANT TO ORDINANCE NO. 962

The City Council of the City of National City does
hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary hard-
ship , and a result inconsistent with the general purpose and
intent of Ordinance No. 962 would occur through strict appli-
cation of the provisions of said Ordinance to that certain
real property hereinafter described.
2. That a Petition requesting a variance has been
filed pursuant to the provisions of Section 12 of said Ordin-
ance and said Petition complies with all the requirements of
said section.
3. That the National City Planning Commission did
hold a hearing on said Petition and did recommend to the City
Council that a variance be granted.
4. That the granting of a variance with reference
to the property hereinafter described will not defeat, but
rather will carry out the general intent and purpose of the
National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said
Ordinance No. 962 be and hereby is granted with reference to
all the certain real property situated in the City of National
City, California, more particularly described as follows:
That portion of Quarter Section 106 of Rancho de la Nacion in
the City of National City, County of San Diego, State of Calif-
ornia, according to Map thereof No. 166, filed in the office
of the County Recorder of said San Diego County, May 11, 1869,
described as follows:
Beginning at a point in the center line of a public street
80.00 feet wide (8th Street) distant thereon North 71° 00'00"
East, 165.00 feet from the Northwesterly corner of said
Quarter Section 106; thence at right angles South 19° 00'
00" East, 190.00 feet; thence at right angles North 71° 00'
00" East, 190.00 feet; thence at right angles North 19° 00'
00" West, 190.00 feet to the center line of said public
street and the Northerly line of said Quarter Section 106;
thence along said center line and said Northerly line South
71° 00' 00" West, 190.00 feet to the TRUE POINT OF BEGINNING.
6. That the variance hereby granted is as fol-
lows: Construct, operate and maintain, or to lease for the
operation and maintenance of a mortuary with chapel on the
subject property subject to the following conditions:
a. All development Plans, including architect-
ural rendering of an exterior elevation, dimensions and
locations of all proposed structures, parking spaces, land-
scaping, and such additional information as may be requested
by the Planning Commission, be approved by the Planning Com-
mission and remain on file in the Planning Department.
b. Off street parking be installed and provided at
a ratio of one space, 9 feet by 20 feet minimum for each
300 square feet of gross floor area or fraction thereof.
c. A 10 foot setback be maintained from 8th Street
property line. Said 10 foot front yard setback, excluding
driveways, be entirely landscaped with any combination of
lawn, flowers, trees, shrubs, pools, fountains, and/or dec-
orative ground cover. All required landscaping shall be pro-
vided with permanent watering system and shall be permanently
maintained in a growing and healthy condition, including
necessary trimming as appropriate to the landscaping mater-
ial. Permitting any portion of the required landscaping to
die, or become deteriorated and not replaced, shall consti-
tute prima facia evidence of a violation of the Zoning Ordi-
nance of the City of National City.
d. A grading plan be approved by the City Engineer
prior to excavation or fill with proper slope protection pro-
vided. All slopes constructed or required shall be planted
to prevent erosion. At the top of all slopes a curb to be
installed to prevent cars from running over the embankments.
e. A drainage plan and all drainage structure as
to location and design shall be approved by the City Engineer
along with the grading plan.
f. Sidewalks shall be installed the entire width
of subject property on 8th Street prior to final inspection
by the Building Inspector.
g. In view of the proposed use, off street park-
ing may be permitted to be installed parallel behind one
another with one major ingress and egress.
h. Landscaping be submitted to the City Park
Director for approval before it is submitted to the Planning
Commission.
i. That the sign, architectural drawing and type
of lighting be submitted along with his plans for approval
at the same time as the building plan.
7. In the event that the City Council should here-
after find and determine that the conditions above set forth
have not been satisfied, it may declare this variance void
and of no further effect.
