RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT
FOR THE IMPROVEMENT OF 3OTH STREET AND SWEETWATER ROAD
FROM "B" AVENUE TO FREEWAY 805
BE IT RESOLVED by the City Council of the City of
National City that the Mayor and City Clerk be authorized to
execute and attest that certain Proposed Cooperative Agree-
ment for the improvement of 30th Street and Sweetwater Road
from "B" Avenue to proposed Interstate Highway 805 between
the City of National City, the City of Chula Vista and the
County of :San Diego, a copy of which is attached.

AGREEMENT
CITY OF NATIONAL CITY
ORIGINAL
THIS AGREEMENT, executed this day of , 1967, by and
between the CITY OF NATIONAL CITY, a municipal corporation, hereinafter called
"National City"; the CITY OF CHULA VISTA, a municipal corporation, hereinafter
called "Chula Vista"; and the COUNTY OF SAN DIEGO, a political subdivision of the
State of California, hereinafter called the "County".
WITNESSETH:
WHEREAS, National City, Chula Vista, and the County desire to enter into a
joint cooperative agreement to improve by widening to four lanes a portion of
30th Street and Sweetwater Road, a continuous street and road within and adjacent
to the jurisdictions of these public agencies, from B Avenue to approximately 0.19
miles westerly of Proposed Interstate Highway No. 805, a distance of approxi-
mately 1.06 miles.
WHEREAS, National City, Chula Vista, and the County desire to proceed with
the construction of said improvement and to share in the cost of such construction.
NOW THEREFORE, IT IS MUTUALLY AGREED by and between National City, Chula Vista,
and the County as follows:
1. National City, Chula Vista, and the County shall cause to be improved by
widening to four lanes that portion of 30th Street and Sweetwater Road, a continuous
street and road within and adjacent to the jurisdictions of these public agencies
from B Avenue to approximately 0.19 miles westerly of proposed Interstate Highway
No. 805, a distance of approximately 1.06 miles.
A section of this project, namely the intersection of Sweetwater Road and
Edgemere Street shall be reconstructed as soon as possible and prior to the
remainder of the whole project, the cost of this section to be interim financed
by the County pending deposits required by Paragraph 5 of this agreement. The
procedures set forth in Paragraphs Nos. 4 and 7 of this agreement also apply to
this construction.
2. That in general the distribution of the work and the responsibility
therefor is as follows:
a. That the County will design and prepare plans and specifications for
the project;
b. That the County will provide all inspection and contract management
services;
c. That the County will perform all material engineering necessary to
determine a suitable structural section, and for control testing during the
construction of the project.
d. All costs incurred by the County for preliminary engineering, design
and construction engineering expenses, inspection and contract management
services shall be shared by National City, Chula Vista, and the County in
amounts based upon the respective percentages set forth in Paragraph No. 5
of this. agreement.
3. In the event right of way must be purchased or condemned it will be the
responsibility of the agency in whose jurisdiction the property is located to
acquire the necessary right of way within its jurisdiction; provided, however,
that National City and/or Chula Vista respectively, shall reimburse the County
for necessary right of way purchased or condemned by the County which is part of
a parcel of real property presently within the County jurisdiction if the parcel
has been annexed to National City and/or Chula Vista prior to acquisition as
evidenced by the recordation of a final order of condemnation, grant deed, or
deed of easement for such right of way.
In the event right of way must be acquired which lies partially within
the County and partially within either or both cities, the County shall acquire
the full right of way and the affected city and/or cities, each shall deposit with
the County, prior to the date on which the acquisition payment is due, an amount
which bears the same ratio to the full acquisition cost as that portion of the
parcel lying within its respective boundary bears to the full property acquired.
Prior to the close of any negotiation, the County and the affected city and/or

cities shall agree as to the acquisition cost of such right of way and said cost
shall be subject to the approval of both the city and County. In the event
right of way investigations indicate that it will be more advantageous for the
affected city to acquire right of way falling in the above mentioned category, it
may be mutually agreed that the affected city will acquire said right of way and
that the procedure outlined above may be reversed substituting therein County for
city and/or cities and city and/or cities for County.
4. After bids for any improvement have been received and opened by the County
and prior to the award of any contract for said improvement by the County, the
County shall notify National City and Chula Vista of the lowest responsible bid
thereof. If either National City or Chula Vista wishes to reject for cause the
award of the contract in accordance with the lowest responsible bid, the County
shall reject all bids and advertise for new bids based either on existing contract
documents or based on revised plans and specifications. If the contract cannot be
awarded, National City and Chula Vista will reimburse the County for each its
share of engineering. The County will furnish each city a reproducible set of
plans and specifications for its respective use at a future date.
5. After approval by National City and Chula Vista of the responsible low
bidder but prior to the award of contract, each city shall separately deposit with
the County, its proportionate share of the total construction cost of the improve-
ment, including the construction cost of the prior construction of the intersection
of Sweetwater Road and Edgemere Street as set forth in Paragraph No. 1 of this
agreement. National City's share of the cost of this improvement shall be
thirty-six and seven -tenths percent (36.7%); Chula Vista's share thereof shall be
eight and three -tenths percent (8.3%); and the County's share thereof shall be
fifty-five percent (55.0%).
6. After the final determination of construction costs, including. utility
relocation if such there be, the County will apply any excess in either city's
construction cost deposit to the respective city's share of engineering. If there
is a deficiency in either city's construction cost deposit, it will be added to
the respective city's share of engineering cost to accomplish the sharing of costs
hereinabove provided. Final payment is due and payable upon receipt of the bill
from the County.
7. This project shall consist, in general, of the construction of paved roadway
68 feet wide to provide a four -lane highway with shoulders and left -turn lanes at
certain locations. The plans and specifications for this improvement shall meet the
approval of the State of California Division of Highways and shall be approved by the
City Engineers on behalf of the respective cities and by the County Engineer on behalf
of the County.
8. The County shall furnish each city an annual report which provides for
the strict accountability of all funds, receipts and disbursements in accordance with
Section 6505 of the Government Code.
IN WITNESS WHEREOF, this agreement is executed by the County of San Diego by
action taken by the Board of Supervisors; by the City of National City by action
taken by the City Council; and by the City of Chula Vista by action taken by the
City Council.
