HomeMy WebLinkAboutCC RESO 9411RESOLUTION NO. o� 4 A RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC IN- TEREST, CONVENIENCE AND NECESSITY OF THE CITY OF NATIONAL CITY REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE OF PUBLIC STREET ACROSS CERTAIN DESCRIBED LAND IN THE CITY OF NATIONAL CITY, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA; AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF SLOPS RIGHTS ON SAID PROPERTY TO BE USED BY SAID CITY FOR SAID PURPOSE; AND DECLARING THE INTENTION OF THE CITY OF NATIONAL CITY TO ACQUIRE SAID PROP- ERTY RIGHTS UNDER EMINENT DOMAIN PROCEEDINGS; AND DIRECTING THE CITY ATIUPNEY OF THE CITY OF NATIONAL CITY TO COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA IN AND FOR THE COUNTY OF SAN DIEGO FOR THE PURPOSE OF AC- QUIRING SAID PROPERTY RIGHTS. (30th Street) BE IT RESOLVED by the Council of the City of National City as follows: SECTION 1: That the public interest, convenience and necessity of the City of National City and the inhabitants thereof require the construction, operation and maintenance of public streets across that certain parcel of real property identified as Parcel 1 and Parcel 2 herein, located in the City of National City, County of San Diego, State of Calif- ornia, and fully described in Exhibits "A" and "B" hereto, which said Exhibits are attached hereto and by this reference incorporated herein and made a part hereof as though set forth in full, SECTION 2: That the public interest, convenience, and necessity of said City and inhabitants thereof demand the acquisition and taking of slope rights on said property for the construction, operation and maintenance of the afore- said public streets lying within the City of National City, County of San Diego, State of California, SECTION 3: That the property upon which the said slope rights to be condemned, being Parcel 1 and Parcel 2, is fully described in Exhibits "A" and "B", attached hereto and incorporated by reference in Section 1 above, SECTION 4: That the taking and acquiring by said City of the property rights described in Exhibits "A" and "B" hereto is deemed necessary for the construction, opera- tion and maintenance of said public streets by the City of National City and the inhabitants thereof for municipal purposes; that such uses are public uses and that for such public uses itis necessary that the City of National City condemn and acquire the property rights hereinabove des- cribed; that the property rights hereinabove described are to be used for the construction, operation and mainten- ance of the said public streets, SECTION 5: That the City Attorney of the City of National City be and he is hereby authorized and directed to commence an action in the Superior Court of the State of California in and for the County of San Diego, in the name and on behalf of the City of National City against all owners and claimants of the above described property rights for the purpose of condemning and acquiring said property rights for the use of said City. LEGAL DESCRIPTION Parcel 1 562-190-01 That portion of lot 8, Block 3 of Budd Villa Tract, according tothe map thereof No. 1067, filed in the office of the Recorder of the County of San Diego, State of California, June 19, 1907, together with that portion of "B" Avenue, vacated and closed to public use, adjacent to said lot 8, which lie Southwesterly of the following described line: Beginning at a point on the center line of said "B" Avenue, 110 feet Northerly from the center line of Thirtieth Street, (80 feet in width), thence in a straight line Southeasterly to a point on the center line of the alley in said Block 3 which is 50 feet Northerly of the center line of said Thirtieth Street.
