HomeMy WebLinkAboutCC RESO 9426RESOLUTION NO. g4.25 RESOLUTION SUSPENDING THE ISSUANCE OF BUILDING PERMITS IN THE RE-DEVETf;PMENT AREA WHEREAS, the City Council has adopted Ordinance No. 1164 activating the National City Redevelopment Agency, and, WHEREAS, the said ordinance has been approved by the people at a Special Election and is now in effect, and WHEREAS, the City Council has be ordinance no. 1169 restricted the authority of the Redevelopment Agency to function to an area of the City of National City bounded by 18th Street, National Avenue, 30th Street and Kimball School, and WHEREAS, the City Council, sitting as the National City Redevelopment Agency, is proceeding with plans for a redevelopment project within the adjacent industrial zone, and WHEREAS, a comprehensive study or redevelopment plan cannot be accomplished unless the status quo of the area is maintained for a period of time reasonably calculated to allowing study of redevelopment plan to be made; NOW, THEREFORE, BE IT RESOLVED that the issuance of building permits is hereby suspended for that part of the City of National City bounded by 18th Street, National Avenue, 30th Street and Kimball School. BE IT FURTHER RESOLVED that an applicant for a building permit within the described area may appeal the refusal of the issuance of a permit to the City Planning Commission and then to the City Council if a proposed im- provement is, in the judgment of the City Council, consistent with the projected redevelopment project, or outside the boundaries of the Proposal Project area the City 'Council, upon recommendation of the City Planning Commission may authorize the issuance of a building permit. BE IT FURTHER RESOLVED, that the applicant who appeals the denial of the issuance of a building permit shall make his appeal to the City Planning Commission in writing, together with the documents, plans, data, and supporting professional opinions that may be required by the Planning Commission. Within 30 days of the receipt of a written appeal, together with all required supporting documents and data, the City Planning Commission shall make its recommendation to the City Council. If the applicant desires to appeal the recommendation of the City Planning Commission he must make a written appeal and submit the supporting plans and data to sustain his position. The City Council, prior to hearing the appeal, may require such further technical and profession- al reports as they deem necessary to fairly consider the ap- peal. Within 30 days of the receipt of an appeal from the City Planning Commission the City Council shall hold a pub- lic hearing, which may be continued from time to time at which time theapplicant's appeal shall be considered. Within 10 days after the close of the hearing on appeal the City Council shall make its determination on the appeal. PASSED AND ADOPTED this 15th day of August, 1967. ATTEST:
