HomeMy WebLinkAboutCC RESO 9292RESOLUTION NO. 9292 RESOLUTION DIRECTING THE ABATEMENT OF A PUBLIC NUISANCE WHEREAS, a group of buildings in the City of National City located on property commonly known as 2240 Cleveland Avenue have been inspected by the Director of Building and Housing and the Fire Marshal on August 9, 1966 and August 17, 1966, and WHEREAS, the Director of Building and Housing and the Fire Marshal have determined that said buildings are structurally unsafe, constitute a fire hazard, and are other- wise dangerous to human life and are a hazard to safety, health and public welfare by reason of inadequate maintenance, dilapidation, and obsolescence, and WHEREAS, the owner of said property has been per- sonally notified' of the existence of the harzardous and un- safe conditions of his property, and WHEREAS, the owner of the said property has on four separate occasions had hearings before the Director of Building and Housing at which time the owner of said property has agreed that the structures in question do constitute a hazard to safety, health and the public welfare, and WHEREAS, on November 14, 1966 the owner of the said property represented to the City of National City and its Director of Building and Housing that he would pursue a course of renovation of the subject premises to the end that they could comply in all respects with the laws of this City, and WHEREAS, in reliance upon the representations of the said owner the City of National City, its officers and employees having foregone their right to close the subject premises to entry and cause the immediate eviction of the occupants thereof and to pursue all the other remedies provided for in the Uniform Building Code, and WHEREAS, the owner of the subject property has failed, refused and neglected to renovate the subject prop- erty and the subject property is still unsafe and a hazard to health, safety and public welfare by reason of its dilap- idated condition; NOW, THERh 0RE, BE IT RESOLVED by the City Council of the City of National City that: This Council finds the substandard buildings at 2240 Cleveland Avenue, National City, owned by Wilbur F. Bradley and Zipha W. Bradley to be a public nuisance. BE IT FURTHER RESOLVED that the City Attorney is authorized and directed to institute legal proceedings to abate said public nuisance; and the City Clerk is directed to advance the necessary costs of said proceedings.
