HomeMy WebLinkAboutCC RESO 9293RESOLUTION NO. 9293 A RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC INTER- EST, CONVENIENCE AND NECESSITY OF THE CITY OF NATIONAL CITY REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE OF PUBLIC STREET ACROSS CERTAIN DESCRIBED LAND IN THE CITY OF NATIONAL CITY, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA; AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISI- TION OF FEE TITLE TO SAID PROPERTY TO BE USED BY SAID CITY FOR SAID PURPOSE; AND DECLARING THE INTENTION OF THE CITY OF NATIONAL CITY TO ACQUIRE SAID PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS; AND DIRECTING THE CITY ATTORNEY OF THE CITY OF NATIONAL CITY TO COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIF- ORNIA IN AND FOR THE COUNTY OF SAN DIEGO FOR THE PURPOSE OF ACQUIRING SAID PROPERTY. (Kelco Company) BE IT RESOLVED by the Council of the City of National City as follows: SECTION 1: That the public interest, convenience and necessity of the City of National City and the inhabitants thereof require the construction, operation and maintenance of public streets across that certain parcel of real property iden- tified as Parcel 1 herein, located in the City of National City, County of San Diego, ;State of California, and fully described in exhibit "A" hereto, which said Exhibit is attached hereto and by this reference incorporated herein and made a part hereof as though set forth in full, SECTION 2: That the public interest, convenience, and necessity of said City and inhabitants thereof demand the acquisition and taking of fee title to said property for the construction, operation and maintenance of the aforesaid pub- lic streets lying within the City of National City, County of San Diego, State of California, SECTION 3: That the property to be condemned, being Parcel 1, is fully described in Exhibit "A" attached hereto and incorporated by reference in Section 1 above, SECTION 4: That the taking and acquiring by said City of the property described in Exhibit "A" hereto is deemed necessary for the construction, operation and main- tenance of said public streets by the City of National City and the inhabitants thereof for municipal purposes; that such uses are public uses and that for such public uses it is necessary that the City of National City condemn and acquire the property hereinabove described; that the property herein - above described is to be used for the construction, operation and maintenance of the said public streets, SECTION 5: That the City Attorney of the City of National City be and he is hereby authorized and directed to commence an action in the Superior Court of the State of California in and for the County of San Diego, in the name and on behalf of the City of National City against all owners and claimants of the above described property for the purpose of condemning and acquiring said property for the use of said City. ATTEST: PASSED AND ADOPTED this 31st day of January, 1967. CITY CLERK DESCRIPTION OF THE SOUTHERLY PROLONGATION OF COOLIDGE AVENUE TO THE SOUTHERLY BOUNDARY OF THE CITY OF NATIONAL CITY. Those portions of Lot 105 and 106 of Bahia Vista, in the City of National City, County of San Diego, State of California, according to the Map thereof No. 1815 filed in the office of the County Recorder of said San Diego County, December 19, 1924, described as follows: Beginning at the intersection of the Easterly line of Coolidge Avenue as dedicated by Resolution No. 8620 of the City of National City, with the Southerly boundary of that portion of said Bahia Vista conveyed to the City of National City by deed dated September 24, 1954 and recorded in Book 5410 at page 330 of the Official Records of said County; thence South 18° 35' East along the Southerly prolongation of said Easterly line to the Southerly boundary of said Bahia Vista, being a point on the Southerly line of said Lot 106; thence South 71° 25' West according to said Map No. 1815, a distance of 80.00 feet to a point on the Southerly line of said Lot 105 being also a point on a line parallel with and 80.00 feet Westerly at right angles to said Easterly line; thence North 18° 35' West along said parallel line to the intersection of the Westerly line of said Coolidge Avenue as dedicated by said Resolution No. 8620 and being the Southerly prolongation thereof. TOGETHER WITH the right to construct earth embankment slopes on those portions of Lots 104 through 107 inclusive lying adjacent to and 20 feet Easterly measured at right angles to the Easterly line and adjacent to and 20 feet Westerly measured at right angles to the Westerly line of the above described parcel of land.
