RESOLUTION DECLARING THAT THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY FINDS THAT THE BUILDING, HOUSING, PLUMBING,
HEATING AND COMFOR COOLING,AND ELECTRICAL CODES AS A
WHOLE PRESCRIBE MINIMUM STANDARDS EQUAL TO OR GREATER THAN
THOSE PRESCRIBED BY THE STATE HOUSING LAW AND BY TITLE 8
OF THE CALIFORNIA ADMINISTRATIVE CODE.
WHEREAS, Section 19825, subdivisions (a) and(c) of
the Health and Safety Code provides that:
(a) The provisions of Part 1.5 (commencing with
Section 17910) of this division and of Chapter 1 (commencing
with Section 19000), Chapter 2 (commencing with Section 19100),
and Chapter 3 (commencing with Section 19300) of Part 3 of this
division shall not apply within any city having and enforcing
a local ordinance prescribing minimum standards equal to or
greater than such provisions of this division; such local or-
dinance shall supersede such provisions of this division.
(c) The provisions of this chapter shall be effective
only in a city where the legislative body determines that an
ordinance described in subdivision (a) of this section is in
force and effect and so notifies the state department presently
charged with enforcement of the provisions of this division if
a state department be so charged.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of National City does hereby find and determine
that the Building, Housing, Plubming, Heating and Comfort Cool-
ing, and Electrical Codes of the National City Municipal Code,
as a whole, prescribe minimum standards equal to or greater
than those prescribed by the State Housing Law and by Title 8
of the California Administrative Code; and
BE IT FURTHER RESOLVED, that the City Council does
hereby intend that these Building, Housing, Plumbing, Heating
and Comfort Cooling, and Electrical Codes shall therefore
apply in the City of National City and shall supersede the
State Housing Law and Title 8 of the California Administrative
Code; and
BE IT FURTHER RESOLVED, that the City Clerk shall
so notify the Division of Building and Housing Standards,
Department of Housing and Community Development, State of
California.
