A RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC
INTEREST, CONVENIENCE AND NECESSITY OF THE CITY OF NATIONAL
CITY REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE
OF PUBLIC STREET ACROSS CERTAIN DESCRIBED LAND IN THE CITY
OF NATIONAL CITY, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA;
AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY
DEMAND THE ACQUISITION OF FEE TITLE TO SAID PROPERTY TO BE
USED BY SAID CITY FOR SAID PURPOSE; AND DECLARING THE
INTENTION OF THE CITY OF NATIONAL CITY TO ACQUIRE SAID
PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS; COMMENCE AN
ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA IN
AND FOR THE COUNTY OF SAN DIEGO FOR THE PURPOSE OF ACQUIRING
SAID PROPERTY.

BE IT RESOLVED by the Council of the City of
National City as follows:
SECTION 1: That the public interest, convenience
and necessity of the City of National City and the inhabitants
thereof require the construction, operation and maintenance of
public streets across that certain parcel of real property
identified as Parcels 1, 2, and 3 herein, located in the City
of National City, County of San Diego, State of California,
and fully described in Exhibit "A" hereto, which said Exhibit
is attached hereto and by this reference incorporated herein
and made a part hereof as though set forth in full,
SECTION 2: That the public interest, convenience,
and necessity of said City and inhabitants thereof demand the
acquisition and taking of fee title to said property for the
construction, operation and maintenance of the aforesaid pub-
lic streets lying within the City of National City, County of
San Diego, State of California,
SECTION 3: That the property to be condemned, being
Parcels 1, 2 and 3, is fully described in Exhibit "A" attached
hereto and incorporated by reference in Section 1 above,
SECTION 4: That the taking and acquiring by said
City of the property described in Exhibit "A" hereto is deemed
necessary for the construction, operation and maintenance
of said public streets by the City of National City and the
inhabitants thereof for municipal purposes; that such uses
are public uses and that for such public uses it is necessary
that the City of National City condemn and acquire the prop-
erty hereinabove described; that the property hereinabove
described is to be used for the construction, operation and
maintenance of the said public streets,
SECTION 5: That the City Council finds that the sev-
erance damages resulting from the taking of a part of Parcel
No. 3 will be equal to the fair market value of the entire
piece of real property owned by Frances H. Cusack and there-
fore, the City Council finds and declares the public interest
and necessity require that the entire parcel of real property
owned by Frances H. Cusack be acquired by condemnation,
SECTION 6: That the City Attorney of the City of
National City be and he is hereby authorized and directed to
commence an action in the Superior Court of the State of
California in and for the County of San Diego, in the name
and on behalf of the City of National City against all
owners and claimants of the above described property for the
purpose of condemning and acquiring said property for the use
of said City.

The Westerly 75 feet of Lots 9 and 10 in Block 1 of Budd Villa
Tract in the City of National City, County of San Diego, State
of California, according to the Map thereof No. 1067, filed in
the office of the Recorder of said San Diego County, June 19, 1907.
PARCEL 2:
Lots 8 through 13 inclusive, in Block 1 of Budd Villa Tract, in
the City of National City, County of San Diego, State of California,
according to Map thereof No. 1067, filed in the office of the County
Recorder of San Diego County June 19, 1907. Also that portion of
the alley in said Block 1 adjoining said Lots as closed December 2,
1919 by Resolution No. 574 of the Board of Trustees of the City of
National City.
EXCEPTING FROM the above described land the Easterly 57.5 feet of
said Lot 13 and the Westerly 75.00 feet of Lots 9 and 10.
ALSO EXCEPTING THEREFROM, the Easterly 20.00 feet of Lots 11 and 12.
ALSO EXCEPTING that portion of
above described, on the South,

Lots 14 and 15 in Block 1 of Budd Villa Tract, in the City of National
City, County of San Diego, State of California, according to Map
thereof No. 1067 filed in the office of the County Recorder of said
San Diego County, June 19, 1907, together with that portion of the
Easterly half of the alley adjacent thereto as vacated and closed to
public use on December 2, 1919 by Resolution No. 574 of the Board
of Trustees of the City of National City.
EXCEPTING THEREFROM, the Easterly 60.00 feet of said Lots 14 and 15.
Lot 7 in Block 1 of Budd Villa Tract, in the City of National City,
County of San Diego, State of California, according to Map thereof
No. 1067 filed in the office of the County Recorder of said San
Diego County June 19, 1907, together with that portion of the Westerly
half of the alley adjacent thereto on the East as vacated and closed
to public use on December 2, 1919 by Resolution No. 574 of the Board
of Trustees of the City of National City.
EXCEPTING THEREFROM, the Northerly 15.00 feet thereof.
The Westerly 40.00 feet of the Easterly 60.00 feet of Lots 14 and
15 and the Westerly 37.50 feet of the Easterly 57.50 feet of Lot 13,
all in Block 1 of Budd Villa Tract in the City of National City, County
of San Diego, State of California, according to map thereof No. 1067,
filed in the office of the County Recorder of said San Diego County
June 19, 1907.
