RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT FOR PRIVATE FIRE PROTECTION SERVICE
BE IT RESOLVED by the City Council of the City
of National City that the Mayor and City Clerk be authorized
to execute and attest that certain Agreement for Private
Fire Protection Service between the City of National City
and the California -American Water Company, a copy of which
is attached.
PASSED AND ADOPTED this 3rd day of May, 1966.

AGREEMENT FOR PRIVATE FIRE
PROTECTION SERVIC.
WE, THE CITY OF NATIONAL CITY, of 1243 National Avenue,
National City, California, hereby apply for installation of a six
(6) inch service and other necessary facilities for Private Fire
Protection Service to serve the property located at 1243 National
Avenue, National City, California.
Upon completion of the construction of the required
facilities, California -American Water Company will render service
in accordance with its rates, rules and regulations on file from
time to time with the Public Utilities Commission of the State of
California, especially in accordance with Schedule No. SW-4,
Private Fire Protection Service, a copy of which is attached
hereto as Exhibit "A" and made a part hereof.
1. The vault containing check valves, meters
and/or other facilities to detect and measure
the use of water shall be located on the property
at 1243 National Avenue, National City, California.
on the East side of National Avenue, 200 feet South
of 12th Street, and we hereby agree to provide an
easement to California -American Water Company
sufficient to cover all facilities in connection
herewith; and we further agree that the Company
shall be under no obligation to commence construction
until such easement is provided.
2. This Private Fire Protection Service will
be completely isolated from all other water pipes
and services to or on property to be served.
3. This agreement shall at all times be subject
to such changes or modification by the Public
Utilities Commission of the State of California
as said Commission may, from time to time, direct
in the exercise of its jurisdiction.

SPECIAL CONDITIONS
1. The minimum diameter will be 4 inches, and the maximum
diameter will be the diameter of the main to which the service
is connected.
2. The installation housing the detector -type check valve
and meter and appurtenances thereto shall be in a location mutually
agreeable to the applicant and the utility. Normally, such in-
stallation shall be located on the premises of applicant, adjacent
to the property line. Utility shall have full right of access
thereto, and applicant shall provide utility with satisfactory
easements to cover all such facilities when they are installed on
premises of applicant. If such facilities are not located on
applicant's property, and a governmental authority requires that
they be moved or relocated, the costs incurred in such movingor
relocation shall be borne by the applicant.
3. If a distribution main of adequate size to serve a
private fire protection system in addition to all other normal
service does not exist in the street or•alley adjacent to the
premises to be served, then a main from the nearest existing
main of adequate capacity shall be installed by the utility and
the cost paid by the applicant. Such payment shall not be
subject to refund.

4: Utility will•'bear the installed cost of service pipe
between the main and the property line. The cost of the vault;
check valves, meters, and appurtenances thereto shall be paid by
.applicant. Such payment shall not be subject to refund. Upon
installation such facilities shall become the property of utility
free and clear of all claims of any persons whatsoever; and
applicant shall advise utility of the cost thereof if installed
by applicant.

5. Service under this schedule will be furnished only for
automatic sprinkler systems which are not interconnected with
other water pipes of the applicant, except as provided for in
Special Condition No. 7 hereafter.
/6. For water delivered for other than fire protection pv.r
poses, charges shall be made therefor under Schedule No. 1, Genera:.
Metered Service.
7. If applicant desires to install automatic sprinkler
systems on the property in connection with his domestic or co-1-
mercial service, whereby a larger service and meter are required
than would be required for his domestic or commercial service
alone, such service may be installed, at the option of the ut:li`..
and the utility shall require applicant.to bear the entire co:>t C:
such service and meter, not subject to refund; however, credit 'r,..-_
be given for the estimated cost of the service and meter that
be adequate for normal domestic or commercial service; o•r, in the
event an existing service is replaced at the request of applicant,
credit will be given for any salvage value recovered. In instarilces
in which facilities are combined, as provided for above, the
amounts of water used for fire protection purposes shall be es-
timated by the utility, and no charge shall be made for water so
used.
8. The utility will supply only such water at such pressure
as may be available from time to time as a result of its normal
operation of the system.
9. The applicant shall indemnify the utility and save it
harmless against any and all claims arising out of the service
under this schedule, and shall further agree to make no claim
against the utility for any loss or damage resulting from such
service.
