RESOLUTION AUTHORIZIN'. EXECUTION OF A3REEh'ENT
(Olivewood Housing)
RE IT RESOLVED by the City Council of the City of National
City that the City Manager be authorized to sign the contract
for the removal of houses of the OLIVEWOOD HOUSIN. TRACT.
PASSED AND ADOPTED this 23rd day of August, 1966.

A CONTRACT TO PURCHASE AND REMOVE CITY
OWNED HOUSES
1. PARTIES: The parties to this agreement are the
City of National City, a Municipal Corporation, hereinafter
referred to as the City and Pedro Morales, hereinafter referred
to as contractor.
WHEREAS, the City desires to sell certain city
owned houses located on City property commonly known as Olive-
wood Housing; and,
WHEREAS, the contractor desires to purchase said
houses; the parties hereto, in exchange for the price later
stated and for other good and sufficient consideration, do agree
as hereinafter set forth.
2. PURPOSE: The purpose of this agreement is to
effectuate the sale and speedy removal of city owned buildings,

previously used as dwellings and now surplus to the needs of
the City, which buildings are all of the dwelling houses pres-
ently located in and on that certain part of the City of National
City commonly known as Olivewood Housing project, the boundaries
of which are fixed and set according to the map which is marked
Exhibit "A" and attached hereto and incorporated herein as if
fully set forth.
3. DUTIES OF CONTRACTOR:
(a) The duties of the contractor will be to
remove from the Olivewood Housing Project all city owned build-
ings. The removal of said buildings is to be accomplished by
contractor in a workmanlike fashion according to good contracting
principals to the end that as little damage as possible will
be done to city owned real property, personal property, streets,
sidewalks, curbs and other public improvement.
(b) The order of removal of the city owned build-
ings shall be in the alphabetical and numerical order shown on
Exhibit "A", to wit: The buildings in group "A" shall first be
removed, then those in group "B", "C", and "D". Within an area
designated alphabetically on Exhibit "A" the buildings shall be
removed in a numerical order starting with the building numbered
"1" and progressing to the highest numbered building in each
group. The contractor shall report the removal of each building
together with the cleaning of the building site. The contractor's
report shall be made on a form provided by the Chief Building
Inspector.

) One half of said houses shall be removed
within three (3) months.
(d)'' Contractor is to begin the removal of said
houses no later than 8:00 a:m.aJ�5X , 1966. In the event
that the contractor, without sufficient reason, fails, refuses
or neglects to complete the performance of each of his duties
under this agreement by the termination date herein set forth
the contractor shall pay as liquidated damage to the city
$50,00 per day or fraction thereof for each day passing without
fullfillment of contractor's obligations under this contract.
(e) Tosecure the full and faithful performance
of this agreement contractor shall deposit with the Clerk of
the city a bond in the amount of $1,000.00, said bond issued by
a surety licensed to do business in the State of California..
(f) Contractor, no later than 24 hours prior to

the begining of performance under this agreement, shall
deposit with the Clerk of the City a certificate of insurance
running to the benefit of the City of National City and the
citizens thereof which certificate evidences that contractor
has public liability insurance in the amount not less than
$100,000.00 for one or more occurance, $10,000.00 for property
damage liability,- and workman's compensation insurance for all
employed in the performance of this contract.
(g) Contractor shall obtain all permits and
licenses necessary to perform this agreement.
(h) As each city owned building is removed
contractor shall clean up and remove from the city owned real
property all debris, rubbish and trash occasioned and caused
by the removal of the said buildings to the end that there
shall be no dangerous, defective, or unsightly condition of
the land as a result of the removal of said buildings.
(i)r Within 24 hours of the execution of this
agreement by both parties, contractor shall pay the purchase
price to the City Clerk in, cash or by the use of a certified
check which check shall order payment unconditionally to the
City of National City. Contract price is the amount of $2,670.99.
4. DUTIES OF THE CITY: The City agrees to draw,
execute and deliver to contractor a good and sufficient bill of
sale for the said city owned buildings upon the completion of
the performance of contractor's duties under this agreement.
MODIFICATION
This contract may be modified by the written agree-
ment of both parties.
ARBITRATION
In the event that a dispute arises between the
parties as to the significance, meaning or effect of a term
or the terms of this agreement or the performance of either
party both parties agree to submit the issues to the arbitra-
tion of the Judge of the National Judicial District, whose
. decision shall be final and binding on both parties. In the
event that said Judge should fail, refuse or neglect to act
or accept appointment under this agreement then the parties
shall submit the dispute to the arbitration of the Judge of
the San Diego Municipal Court then assigned to the South Bay
Division whose decision in arbitration shall likewise be
binding on both parties.
