HomeMy WebLinkAboutCC RESO 8977RESOLUTION NO. 8977 RESOLUTION OF INTENTION (Lanoitan Avenue from l8th Street to 24th Street, Assessment District No. 141) The City Council of the City of National City, California, does hereby resolve, determine and order as follows: Section 1. The public interest and convenience re- quire andit is the intention of the City Council of said. City of National City to order the following work to be done or improvement to be made in the City of National City, to wit: that LANOITAN AVENUE FROM 18TH STREET TO 24TH STREET, ASSESS- MENT DISTRICT NO. 141 be improvedas follows: by the grading, paving, curb and gutter, sidewalk and drainage construction and that any other work auxiliary to any of the above andwhich may be required to carry out the same, be performed.. Section 2. The attention of all persons is directed. to the fact that all of said classes of work above described may not be constructed. upon all of the streets or public ways above mentioned. in their entirety, but only upon the particular locations shown on the plans, specifications and drawings. Section 3. The estimatedcost of saidwork, includ- ing incidental expenses, is the sum of $44,820.76. The City has budgeteda sum equal to 11% of the total project cost as a contribution towardthe cost of said. work. Section 4. All the aforesaid work or improvement shall be constructedat the grades, along the lines, between the points, of the dimensions, at the places andin the manner shown on the plans, specifications, profiles and drawings for the said work approvedand. adoptedby this Council on July 27 1965, by Resolution No. 89744 Said plans, specifications, profiles and. drawings are on file in the office of the City Clerk of the City of National City in the City Hall of said City, and. reference is hereby made to said plans, specifications, profiles and drawings for a full and detaileddescription of saidproposed work andfor a description of the grades at which said. work is to be done. Said grades are hereby adoptedand. establishedas the official grades for all purposes in connec- tion with proceedings pursuant to this Resolution of Intention. Notice is hereby given that said grades may be new and.differ- ent from those heretofore established. or existing, or may be, and. in some cases are, different from existing ground levels. Section 5. This City Council hereby makes the ex- pense of saidwork chargeable upon a district, which district this City Council hereby declares to be the district benefited. by the said work and to be assessed. to pay the cost andexpenses thereof. For a description of said district, reference is here- by made to a plat of said district heretofore approvedby this City Council on file in the office of the City Clerk and desig- nated as "PLAT OF PROPOSED ASSESSMENT DISTRICT NO. 141 THE IM- PROVEMENT OF LANOITAN AVENUE FROM EIGHTEENTH STREET TO TWENTY- FOURTH STREET; ALL IN THE CITY OF NATIONAL CITY, CALIFORNIA." This map indicates by a boundary line the extent of the terri- tory includedin the saidproposeddistrict and. shall govern for all details as to the extent of said. assessment district. Section 6. All public streets or public parks, and all easements or rights of way belonging to the public, and. also all property ownedby the United. States of America or the State of California now in use in the performance of a public function are hereby specifically excluded from this assessment district. Section 7. Serial bonds bearing interest at the rate of six percent (6%) per annum shall be issuedto repre- sent each assessment of fifty dollars ($SO.00) or over remaining unpaid. for thirty (30) days after the date of recordation of the warrant. Said serial bonds shall extend over a period. ending nine (9) years from the secondday of January next suc- ceeding the next September 1 following their date. Said bonds shall be payable to bearer and there shall be added. after the redemption clause in the bond the following language, "together with a premium of five percent (5%) of said. unmatured princi- pal." Said. bonds are to be issuedpursuant to and as provided. in the Improvement Act of 1911, Division 7 of the Streets and. Highways Code of the State of California. Section 8. The said proposed. work is to be done under and proceedings therefore are to be under andpursuant to the said Improvement Act of 1911. Section 9. Notice is hereby given that the 7th day of September, 1965, at the hour of 8:30 p.m. are the day and. hour when, and. the Council Chambers of this City Council in the City Hall in the City of National City is the place where, any andall persons having any protest or objection to said proposed. work or to the extent of said assessment district, or to the proposed. grades, may appear before the City Council of the City of National City and show cause why saidproposed work should not be carried out in accordance with this Resolution of Intention. Protests or objections must be in writing and must be deliveredto the City Clerk of said. City of National City not later than the hour herein set for hearing protests or objections. Section 10. The report of the City Engineer pursuant to the provisions of the Special Assessment Investigation, Lim- itation and. Majority Protest Act of 1931, is on file with the City Clerk of National City andmay be examinedin her office. Section 11. The National City Star News is hereby selected. as the newspaper in which this resolution shall be publishedand. in which all other publications regarding the proceedings pursuant to this Resolution of Intention shall be made. The City Clerk is hereby directed to certify to the adoption of this Resolution and to cause said. Resolution to be publishedin the manner provided by law. Section 12. The City Clerk is hereby directedto mail notices of the adoption of this resolution as provided. in said. Improvement Act of 1911, postage prepaid, to all per- sons owning real property which is proposed to be assessedto pay any part of the cost of saidwork whose names and addresses appear on the last equalizedassessment roll or as known to the City Clerk. Section 13. The Street Superintendent of the City of National City is hereby directed to cause to be conspicuous- ly posted along the line of the contemplated. work and on all open streets within the said assessment district notices of the passage of this Resolution of Intention in the time, form and. manner providedby law. The City of National City has budgeted a sum equal to 11% of construction cost plus right of way acquisition as a contribution towardthe cost of said. work. The remaining costs thereof will be assessedupon the property benefited.. According to the last equalizedroll for taxes you are the owner of property within the boundaries of the district whih will be assessedto pay the costs andexpenses of this improve- ment. Said. Resolution of Intention No. 8977 is on file in the office of the City Clerk of the City of National City and is referred to for all particulars. NOTICE IS HEREBY GIVEN THAT ON: September 7, 1965, at the hour of 8:30 p.m. of saidday, at the meeting place of the City Council of the City of National City, 1243 National Avenue, National City, California has been fixed as the time and place of hearing any and all ob- jections to the proposedwork and improvement, the grades to which saidwork is proposed to be done, or the boundaries of the district. Any persons owning property within the boun- daries of the district may present written protest, not later than the hour hereinabove set for hearing, against the doing of said work, the grades to which said work is to be done or the boundaries of the district proposedto be assessed. Any protest filed must be in writing andmust contain a descrip- tion of the property in which the signer thereof is interested, sufficient to identify the same, and must be delivered to the City Clerk of the City of National City. This work is to be done by special assessment pro- ceedings under the Improvement Act of 1911. Property owners will be able to pay their assessments in cash at the termina- tion of work andconfirmation of the assessment. If any prop- erty owner does not desire to pay for the work in cash, a bond will be issued against the property for the amount of any as- sessment of $50.00 or more, under the Improvement Act of 1911, which bondwill bear interest at the rate of six percent (6%) per annum and will be payable in equal installments over a period of nine (9) years.
