RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962
(Happy Hollow Trailer Park)
The City Council of the City of National City does
hereby find., determine, order and resolve as follows:
1. That practical difficulties, unnecessary hard-
ship, and a result inconsistent with the general purpose and.
intent of Ordinance No. 962 would occur through strict appli-
cation of the provisions of said. Ordinance to that certain
real property hereinafter described.
2. That a Petition requesting a variance has been
filed pursuant to the provisions of Section 12 of said.Ordi-
nance and said. Petition complies with all the requirements of
said. section.
3. That the National City Planning Commission did.
holda hearing on said Petition and did recommendto the City
Council that a variance be granted.
4. That the granting of a variance with reference
t.o the property hereinafter described will not defeat, but
rather will carry out the general intent and. purpose of the
National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said
Ordinance No. 962 be and hereby is granted with reference to
all the certain real property situated in the City of National
City, California, more particularly described as follows:
Parcel 1: That portion of Lot 69 of a portion
of the Ex -Mission Lands of San Diego, (commonly known as Horton's
Purchase) in the City of National City according to Map thereof
No. 283 filed in the office of the Recorder of San Diego County
March 9, 1878, described as follows: Beginning at the South-
west corner of said. Lot 69; thence North 71° 00' East along the
Southerly line of said Lot a distance of 743.82 feet; thence
North 18° 30' West 470.58 feet, more or less, to an intersection
with a line drawn parallel with and.981.75 feet South from the
North line of said Lot; thence west to a point 544.50 feet
West from the East line of said. Lot 69; thence South 20 feet;
thence West 674.52 feet, more or less, to the Westerly line of
said Lot; thence Southerly along said. Westerly line to the
point of beginning. EXCEPTING therefrom the Westerly 348.96
feet, measured at right angles from the Westerly line thereof
and. the Southerly 30 feet thereof as said. Southerly 30 feet
was conveyed to the City of National City by deed. dated May
15, 1953 andrecorded in Book 4986, page 260 of Official
Records. ALSO EXCEPTING therefrom that portion described as
follows: Beginning at the intersection of the Easterly line
of the above described property with the Northerly line of said
Southerly 30 feet conveyed to the City of National City; thence
South 71° 00' West along said Northerly line 110.3 feet; thence
North 18° 23' 30" West 48.00 feet; thence North 48° 36' 30"
East 67.00 feet; thence North 20° 00" East 78.12 feet to the
Easterly line of the above described property; thence South 18°
23' 30" East along said. Easterly line 134.25 feet to the Point
of Beginning.
Parcel 2: The Northerly 258 feet, measured along
the Westerly line thereof, of Lot 1 in Scheuerman Heights, City
of National City, County of San Diego, State of California, ac-
cording to Map thereof #2227 filedin the office of the County
Recorder of San Diego County, June 6, 1938. The Southerly line
of said Northerly 258 feet being drawn parallel with the South-
erly line of said. Lot #1.
Parcel 3: All of Lot 2, EXCEPTING the Southerly
170.03 feet thereof, of Scheuerman Heights, City of National
City, County of San Diego, State of California, according to
map thereof No. 2227, filed. in the office of the County Record-
er of San Diego County, June 6, 1938.
Parcel 4: All of Lot 3, EXCEPTING the Southerly
172.67 feet thereof, of Scheuerman Heights, City of National
City, County of San Diego, State of California, according to
Map thereof #2227, filed in the office of the County Recorder
of San Diego County, June 6, 1938. (999 Division Street).
6. That the variance hereby grantedis as follows:
Zone variance be granted permitting the continuation, operation,
remodeling andmodernizing of an 84 trailer camp and that said
zone variance be transferrable and assignable subject to the
restrictions specifiedin paragraph 7.
7. That saidvariance is hereby granted upon the
following conditions:
(a) That an additional ten (10) feet be dedicated
for the continuation and widening of Division Street.
(b) That a slope easement be granted to the City
of National City to extend the fill slope into subject property
an additional fifteen (15) feet.
(c) That prior to any improvements being made
on the three (3) additional lots, proposedfor improvement in
the application for variance, that evidence be submittedto
the National City Engineering Department, indicating that all
the requirements of Ordinance No. 1052 will be complied with.
(d) That adequate provisions be made to allow
free and immediate access for emergency equipment to all loca-
tions within the park.
(e) That interior yard fire hydrants be installed,
as approved by the Fire Chief, in the existing trailer park.
(f) That in all areas to be expanded upon, pro-
visions be made to install yard hydrants as approved by the
Fire Chief.
(g) That slopes, created by the filling re-
quired to continue Division Street through to Highland Avenue,
in the immediate area of said trailer park, after completion
of the project, be planted with ice plants or other adequate
ground cover to curtail erosion.
(h)
Landscaping be installed. along Division
Street at curb elevation, Southerly boundary of said trailer
park, after the continuation and widening of Division Street
to Highland Avenue has been completed.
(i) That said zone variance shall be granted for
the location known as 999 Division Street and. is for the use
of not more than eighty-four (84) trailers.
(j) Said zone variance will be subject to re-
view by the Planning Commission of the City of National City
two (2) years from date of acceptance by the City Council.
(k) Final improvement plans to be approved by
the Planning Commission as required. by Ordinance No. 962 prior
to the issuance of a permit by the State of California.
8. In the event that the City Council should here-
after find and determine that the conditions above set forth
have not been satisfied, it may declare this variance void.
and of no further effect.
