RESOLUTION ACCEPTING CONVEYANCE OF REAL PROPERTY
(Eustaquio and Felicitas Ramirez and
Advance Testing Corporation)
BE IT RESOLVED by the City Council of the City of
National City, California, as follows:
Pursuant to Resolution No. 7083, the City Clerk is
hereby ordered to execute a.Cert.ificate of Acceptance and to
record. the following instruments conveying an interest in or
easement upon real estate to City of National City:
Covenant Running With Land. and Grant of Lien from
Eustaquio and Felicitas G. Ramirez dated December 20, 1965.
Covenant Running with Land. and Grant of Lien from
Advance Testing Corporation dated December 20, 1965.
PASSED AND ADOPTED this 21st day of December, 1965.

THIS COVENANT AND G .' is made by EUSTAQUIO RAMIREZ
and FELICITAS-G. RAMIREZ, her fter referred to as "OWN"RS".
WHEREAS, EUSTAQUIO .;Z and FELICITAS G. RAMIREZ
are the owners of that certain real property located in the
City of National City County of San Diego, State of California,
described as follows:
All that portion of the Westerly 330 feet of the
Southwest quarter of Quarter Section 104 of Rancho de La Nacion
according to Map thereof by Morrill, No. 166 filed in the office
of the County Recorder of San Diego County, lying Southerly of
the Easterly prolongation of the Southerly line of Lot 60 of
Rancho Hills Unit No. 5, according to Map thereof No. 2475 and
Northerly of the Easterly prolongation of the Southerly line of
Lot 64 of said Rancho Hills Unit No. 5, and Easterly of the most
Easterly line of Rancho Hills Unit No..5. EXCEPTING: thereof
the Southerly 120 feet and. also with the EXCEPTION: thereof of
the Northerly 142 feet. The Easterly 30 feet thereof dedicated
to the City of National City for street purposes as recorded
October 16, 1962, Document 129360, Book 46-26, Page 248.
WHEREAS, said owners desire to construct a structure
on said real property;
NOW, THEREFORE, in consideration for the granting of
a conditional waiver by the City Planning Commission by the
City of National City, California, said Owners covenant and
grant for themselves and their heirs, successors and assigns
as follows:
1. Said Owners shall install curbs, gutters and
sidewalks within 60 days after the completion of the improve-
ment of the street in front of the above described premises,
whether said improvement is accomplished by means of proceed-
ings pursuant to the Improvement Act of 1911, or otherwise.
2. Said Owners agree that in the event a 1911 Act
Project is initiated. for the improvement of the street in front
of the above described premises, that said Owners or their heirs,

THIS COVENANT AND GRANT is made by ADVANCE TESTING CORPOR-
ATION, hereinafter referred to as "OWNERS."
WHEREAS, ADVANCE TESTING CORPORATION are the owners of
that certain real property located in the City of National City,
County of San Diego, State of California, describedas follows:
All of Lots 1 through 10, ,Block 23, as shown on Map -No.
348 filed in the County Recorder's Office.
WHEREAS, said Owners desire to construct a structure on
said real property;
NOW, THEREFORE, in consideration for the granting of a
conditional waiver by the City Planning Commission by the City of
National City, California, said Owners covenant and grant for them-
selves and their heirs, successors and assigns as follows:
1. Said Owners shall install curbs, gutters and sidewalks
adjacent to the Southerly half of the above described property, at
the time said southerly half of the property described or any por-
tion thereof, is developedin any manner, including bu.t not limited
to the construction of a parking lot.
2. Said Owners shall install curbs, gutters and side-
walks within 60 days after the completion of the improvement of the
street in front of the above described premises, whether said im-
provement is accomplice ed by means of proceedings pursuant to the
Improvement Act of 1911, or otherwise..
3. Said Owners agree that in the event a 1911 Act Project
is initiated for the improvement of the street in front of the above
described premises, or the•ailey between 22nd and 23rd Street and
Roosevelt Avenue and National Avenue, that said Owners or their
heirs, successors and assigns will not file or otherwise present a
written or oral protest during said proceedings or any related pro-
ceedings.
4. Said Owners hereby grant to the City of National City,
a lien on all of said property in the amount of $900.00, said amount
representing the estimate by the City Engineer of National City to be
sufficient to install said curbs, gutters and sidewalks. It is spe-
cifically understood that in the event said curbs, gutters and side-
walks are not installed by Owners (a) at the expiration of sixty (60)
days from the date of adoption of a resolution confirming the assess-
ment of any 1911 Act Project on the Street in front of said premises,
or the alley between 22nd and 23rd Street and Roosevelt Avenue and
National Avenue, or (b) within sixty (60) days from the date of ac-
ceptance of street improvements in front of said premises by the City
Council if the work is accomplished by means other than a 1911 Act,
or (c) concurrently with the development of the property as provided
in paragraph 1; that the City of National City may take whatever action
may be necessary to install said curbs, gutters and sidewalks, and
thereafter to foreclose upon the lien herein granted to pay all costs
and fees. It is specifically provided that this lien shall include
reasonable attorney's fees and court costs in the event the City fore-
closes this lien.
