Lanoitan Avenue, Assessment District No. 140) The City Council of the City of National City, California, does hereby resolve, determine and. order as fol- lows: Section 1. The public interest and. convenience require ands t is the intention of the City Council of said City of National City to order the following work to be done or improvement to be made in the City of National City, to wit: that 16TH STREET AND LANOITAN AVENUE, ASSESSMENT DIS- TRICT NO. 140 be improved. as follows: by the Grading, exca- vation, embankment, AC paving, crusher run base, PCC curb side -walk and driveways and. that any other work auxiliary to any of the above and. which may be required. to carry out the same, be performed. Section 2. The attention of all persons is directed. to the fact that all of said classes of work above described. may not be constructed. upon all of the streets or public ways above mentioned. in their entirety, but only upon the particular locations shown on the plans, specifications and drawings. Section 3. The estimated. cost of said. work, includ- ing incidental expenses, is the sum of S173,135.4O. The City has budgeted a sus!: equal to 12.17% o construction cost on Lanoitan Avenue and. 3O of construction cost on loth Street as a contribution toward. the cost of said. work. Section 4. All the aforesaid. work or improvement shall be constructed at the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on thepla:ns, specifications, profiles and drawings for the said. work approved. and. adopted by this Council on March 1965, by Resolution No. gT6 3 . Said plans, specifi- cations, profiles and drawings are on file in the office of the City Clerk of the City of National City in the City Hall of said City, and reference is hereby made to said. plans, speci- fications, profiles and. drawings for a full and detailed des- cription of said proposed. work and for a description of the grades at which said work is to be done. Said grades are hereby adopted and established as the official grades for all purposes in connection with proceedings pursuant to this Res- olution of Intention. Notice is hereby given that said. grades may be new and. different from those heretofore established or existing, or may be, and in some cases are, different from existing ground. levels. Section 5. This City Council hereby makes the ex- pense of said. work chargeable upon a district, which district this City Council hereby declares to be the district benefited. by the s aid. work and. to be assessed. to pay the cost and. ex- penses thereof. For a description of said. district, reference is hereby made to a plat of said district heretofore approved by this City Council on file in the office of the City Clerk and designated. "PLAT OF ASSESSMENT DISTRICT NO. 140, IMPROVE- MENT OF SIXTEENTH STREET FROM "L" AVENUE lU RACHAEL AVENUE AND LANOITAN AVENUE FROM SIXTEENTH STREET 110 EIGHTEENTH STREET, ALL IN THE CITY OF NATIONAL CITY, CALIFORNIA." This map indi- cates by a boundary line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. Section 6. All public streets or public parks, and all easements or rights of way belonging to the public, and. also all property owned. by the United States of America or the State of California now in use in the performance of a public function are hereby specifically excluded. from this assessment district. Section 7. Serial bonds bearing interest at the rate of six percent (6%) per annum shall be issued. to repre- sent each assessment of fifty dollars ($50.00) or over remain- ing unpaid. for thirty (30) days after the date of recordation of the warrant. Said serial bonds shall extend. over a period. ending nine (9) years from the second. day of January next suc- ceeding the next September 1 following their date. Said bonds shall be payable to bearer and there shall be added. after the redemption clause in the bond. the following language, "together with a premium of five percent (5%) of said. unmatured. principal." Said. bonds are to be issued pursuant to and. as provided. in the Improvement Act of 1911, Division 7 of the Streets and. Highways Code of the State of California. Section 8. The said. proposed. work is to be done under and. proceedings therefore are to be under and pursuant to the said. improvement Act of 1911. Section 9. Notice is hereby given that the 27th day of April, 1965, at the hour of 8:00 o'clock p.m. are the day and. hour when, and. the Council Chambers of this City Council in the City Hall in the City of National City is the place where, any and. all persons having any protest or objection to said proposed. work or to the extent of said assessment district, or to the proposed grades, may appear before the City Council of the City of National City and show cause why said proposed. work should. not be carried. out in accordance with this Res- olution of Intention. Protests or objections must be in writing and. must be delivered. to the City Clerk of said. City of National City not later than the hour herein set for hearing protest or objections. Section 10. The report of the City Engineer pur- suant to the provisions of the Special Assessment Investigation, Limitation and. Majority Protest Act of 1931, on file with the City Clerk of National City and may be examined. in her office. Section 11. The National City Star News is hereby selected. as the newspaper in which this reolution shall be published. and. in which all other publications regarding the proceed.inas pursuant to this Resolution of Intention shall be made. The City Clerk is hereby directed. to certify to the adoption of this Resolution and, to cause said Resolution to be published in the manner provided. by law. Section 12. The City Clerk is hereby directed. to mail notices of the adoption of this resolution as provided. in said. Improvement Act of 1911, postage prepaid, to all persons owining real property which is proposed to be assessed to pay any part of the cost of said. work whose names and. addresses appear on the last equalized. assessment roll or as known to the City Clerk. Section 13. The Street Superintendent of the City of National City is hereby directed to cause to be conspicuously posted. along the line of the contemplated. work and on all open streets within the said. assessment district notices of the passage of this Resolution of Intention in the time, form and. manner provided. by law. Resolution of Intention No. 8866 under the pro- visions of the Improvement Act of 1911 for the purpose of ordering the following work to be done and. improve- ments to be made in the City of National City, County of San Diego, State of California, to wit: That 16TH STREET AND LANOITAN AVENUE, ASSESSMENT DISTRICT NO. 140 be improved. as follows: by the grading, excavation, embankment, AC paving, crusher run base, PCC curb, sidewalk and. driveways and that any other work aux- iliary to any of the above and which may be required. to carry out the same, be performed., excepting therefrom all of the herein -described. work of all said work that has already been done to the lines and grades and. in ac- cordance with the plans, specifications and. drawings hereafter described - The estimated cost of the construction of said. improvements is the sum of S173,135.40 in cludinc inciden- tal expenses. The City of National City has budgeted. a sums ual to 12.17% of construction cost on Lanoitan Avenue and 507 of construction cost on 16th Street as a contribu- tion toward. the cost of said. work. The remaining costs thereof will be assessed. upon the property benefited.. Ac- cording to the last equalized. roll for taxes you are the owner of property within the boundaries of the district which will be assessed to pay the costs and. expenses of this improvement. Said. Resolution of intention No. 8866 is on file in the office of the City Clerk of the City of National City and. is referred. to for all particulars. NOTICE IS HEREBY GIVEN THAT ON: April 27, 1965, at the hour of 3:00 p.m. of said. day, at the meeting place of the City Council of the City of National City, 1243 National Avenue, National City, California has been fixed. as the time and place of hearing any and. all objections to the proposed work and. improvement, the grades to which said. work is proposed to be done, or the boundaries of the district. Any persons owning property within the boundaries of the district may present written protest, not later than the hour hereinabove set for hearing, against the doing of said. work, the grades to which said. work is to be done or the boundaries of the district proposed. to be assessed. Any protest filed must be in writing and. must contain a description of the property in which the signer thereof is interested., sufficient to identify the same, and. must be de- livered. to the City Clerk of the City of National City. This work is to be done by special assessment pro- ceedings under the Improvement Act of 1911. Property owners will be able to pay their assessments in cash at the termination of work and. confirmation of the assessment. If any property owner does not desire to pay for the work in cash, a bond. will be issued. against the property for the amount of any assessment of $50.00 or more, under the Improvement Act of 1911, which bond. will bear interest at the rate of six percent (6%) per annum and will be apayable in equal installments over a period. of nine /6) / Dated.: City C erk of the Cit National City (9) years.
