HomeMy WebLinkAboutCC RESO 8972RESOLUTION NO. 8972 RESOLUTION OF INTENTION (Prospect Street Improvements, Assessment District No. 144) The City Council of the City of National City, California, does hereby resolve, determine and. order as follows: Section 1. The public interest and convenience re- quire and it is the intention of the City Council of said City of National City to order the following work to be done or im- provement to be made in the City of National City, to wit: that PROSPECT STREET, ASSESSMENT DISTRICT NO. 144 be improvedas follows: grading, paving, curb and. gutter and. drainage construc- tion and that any other work auxiliary to any of the above and. which may be required to carry out the same, be performed. Section 2. The attention of all persons is directed. to the fact that all of said. classes of work above described may not be constructedupon all of the streets or public ways above mentioned. in their entirety, but only upon the particular locations shown on the plans, specifications and. drawings. Section 3. The estimated cost of said work, including incidential expenses, is the sum of $19,310.68. The City has budgeted a sum equal to 26.83% of the total project cost as a contribution toward the cost of said work. Section 4. All the aforesaid work or improvement shall be constructed at the grades, along the lines, between the points, of the dimensions, at the places andin the manner shown on the plans, specifications, profiles and drawings for the said work approved and adopted. by this Council on July 27 1965, by Resolution No. 8971 Said. plans, specifications, profiles and drawings are on file in the office of the City Clerk of the City of National City in the City Hall of said. City, and reference is hereby made to said plans, specifications, profiles and drawings for a full and. detailed description of said. proposed. work andfor a description of the grades at which said work is to be done. Said grades are hereby adopted. and established. as the official grades for all purposes in con- nection with proceedings pursuant to this Resolution of Inten- tion. Notice is hereby given that said grades may be new and different from those heretofore established. or existing, or may be, and in some cases are, different from existing ground levels. Section 5. This City Council hereby makes the ex- pense of said work chargeable upon a district, which district this City Council hereby declares to be the district benefited by the said work and to be assessed to pay the cost and expenses thereof. For a description of said district, reference is here- by made to a plat of said district heretofore approved by this City Council on file in the office of the City Clerk anddesig- nated. as "CONSTRUCTION PLANS PROSPECT STREET FROM 22ND STREET TO 24TH STREET: This map indicates by a boundary line the ex- tent of the territory includedin the said proposed district and shall govern for all details as to the extent of said assess- ment district. Section 6. All public streets or public parks, and. all easements or rights of way belonging to the public, and. also all property owned by the United States of America or the State of California now in use in the performance of a public function are hereby specifically excluded from this assessment district. Section 7. Serial bonds bearing interest at the rate of six percent (6%) per annum shall be issued. to represent each assessment of fifty dollars ($$50.00) or over remaining unpaid. for thirty (30) days after the date of recordation of the warrant. Said. serial bonds shall extend over a period. ending nine (9) years from the second. day of January next succeeding the next September 1 following their date. Said bonds shall be payable to bearer and there shall be added after the re- demption clause in the bond the following language, "together with a premium of five percent (5%) of said unmatured. princi- pal." Said bonds are to be issued. pursuant to and as provided in the Improvement Act of 1911, Division 7 of the Streets and Highways Code of the State of California. Section 8. The saidproposed work is to be done under andproceedings therefore are to be under and pursuant to the said Improvement Act of 1911. Section 9. Notice is hereby given that the 7th day of September, 1965, at the hour of 8:15 p.m. are the day and hour when, and the Council Chambers of this City Council in the City Hall in the City of National City is the place where, any and all persons having any protest or objection to said pro- posed. work or to the extent of said. assessment district, or to the proposed grades, may appear before the City Council of the City of National City and. show cause why said proposed work should not be carried out in accordance with this Resolution of Intention. Protests or objections must be in writing and. must be delivered to the City Clerk of said City of National City not later than the hour herein set for hearing protests or objections. Section 10. The National City Star News is hereby selected as the newspaper in which this resolution shall be published and. in which all other publications regardingthe proceedings pursuant to this Resolution of Intention shall be made. The City Clerk is hereby direc ted to certify to the adoption of this Resolution and to cause said resolution to be published. in the manner provided by law. Section 11. The City Clerk is hereby directed. to mail notices of the adoption of this resolution as provided in said Improvement Act of 1911, postage prepaid, to all per- sons owning real property which is proposed to be assessed. to pay any part of the cost of said work whose names and addresses appear on the last equalized assessment roll or as known to the City Clerk. Section 12. The Street Superintendent of the City of National City is hereby directed to cause to be conspicu- ously posted along the lines of the contemplated work and on all open streets within the said. assessment district notices of the passage of this Resolution of Intention in the time, form and manner provided. by law. OF ADOPTION OF RESOLUTION OF INTENTION NO. 897' (Prospect Street Improvements, Assessment District No. 144) NOTICE IS HEREBY GIVEN that on July 27, 1965, the City Council of the City of National City passed. and adopted Resolution of Intention No. g972 under the provisions of the Improvement Act of 1911 for the purpose of ordering the following work to be done and. improvements to be made in the City of National City, County of San Diego, State of Calif- ornia to wit: That PROSPECT STREET, ASSESSMENT DISTRICT NO. 144 beimproved. as follows: grading, paving, curb and gutter and. drainage construction and that any other work auxiliary to any of the above and which may be required to Cary out the same, be performed, excepting therefrom all of the herein - described. work of all said work that has already been done to the lines and. grades and. in accordance with the plans, speci- fications anddrawings hereafter described. The remaining costs thereof will be assessed. upon the property benefited. According to the last equalized roll for taxes you are the owner of property within the boundaries of the district which will be assessed to pay the costs and expenses of this improvement. Said. NOTICE IS HEREBY GIVEN THAT ON: September 7, 1965, at the hour of 8:15 p.m. of said day, at the meeting place of the City Council of the City of National City, 1243 National Avenue, National City, California has been fixed as the time andplace of hearing any and all ob- jections to the proposed work and improvement, the grades to which said. work is proposed. to be done, or the boundaries of the district. Any persons owning property within the boun- daries of the district may present written protest, not later than the hour hereinabove set for hearing, against the doing of said work, the grades to which said work is to be done or the boundaries of the district proposed. to be assessed. Any protest filedmust be in writing andmust contain a des- cription of the property in which the signer thereof is in- terested, sufficient to identify the same, and must be delivered, to theCity Clerk of the City of National City. This work is to be done by special assessment pro- ceedings under the Improvement Act of 1911. Property owners will be able to pay their assessments in cash at the termination of work and, confirmation of the assessment. If any property owner does not desire to pay for the work in cash, a bond will be issued. against the property for the amount of any assess- ment of .$50.00 or more, under the Improvement Act of 1911, which bond will bear interest at the rate of six percent (6%) per annum and will be payable in equal installments over a period of nine (9) years.
