HomeMy WebLinkAboutCC RESO 8684RESOLUTION NO. 8684 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962 The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hard- ship, and a result inconsistent with the general purpose and intent of Ordinance No. 962 would occur through strict appli- cation of the provisions of said Ordinance to that certain real property hereinafter described. 2. That a Petition requesting a variance has been filed pursuant to the provisons of Section 12 of said Ordi- nance and said Petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City not Council that a variance/be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. S. That a variance from the provisions of said Ordinance No. 962 be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: A portion of Lot 2 of quarter section 130 as des- cribed below: PARCEL 1. Lots 1, 2, 3, 7, 8 and 9 of Sanitarium Place according to Map No. 1730. PARCEL 2. The west half of the east half of the east half of the north half of 80 acre lot 2 quarter section 130. 6. That the Variance hereby granted is as follows: a. Permission to sort damaged food products into three groups as follows: 1. Those products not fit for human consumption. 2. Those products which are damaged but edible, and which may be used in the Friendship Homes' Sanitarium. 3. Those products which may be retailed in the Consumers Mart Store. b. Permission to repackage bulk flour and sugar. 7. Said Variance is hereby granted upon the following conditions: a. All separation of damaged goods shall be conducted within a structure . b. Re -packaging of merchandise shall be under close supervision of James Cheneweth so as to preclude accidental or mischievous comingling of commodities. c. No sales shall be permitted other than to non -business, retail consumers. d. All merchandise not fit for human consumption to be disposed of in such a manner as to prohibit its accessibility to humans. All such merchandise shall be stored within an air tight container within a locked area not accessible to the public. Said merchandise shall be disposed of each and every day it is condemned by the San Diego County Health Department, but at no time shall such merchandise accumulate for more than one week period of time. e. All vehicles loading and unloading goods shall be located on •private property and shall not encroach upon any dedicated street. f. Curbs, gutters and sidewalks shall be installed on 7th Street in accordance with Ordinance No. 962 and in accordance with the Planning Department staff's recommendations and Engineering Depart- ment specifications. -2 - g. Said operation shall be conducted and maintained in accordance with all applicable City, County, State and Federal ordinances and laws. h. Periodic inspections shall be made by the Planning Department staff. If doubt exists as to correctness of said operation, a report shall be filed with the Planning Commissim and City Council. If the City Council, after recommendation from the Planning Commission, determines the operation is not to the best interest of the health, safety and welfare of the people, or shall determine that all provisions of this Variance have not been complied with, this variance shall become null and void. i. That the above -described operations are conducted by James Cheneweth; upon the sale, lease, assignment or other transfer of any interests in the above -described property or operation by James Cheneweth, this variance shall become null and void. 8. In the event that the City Council should hereafter find and determine that the conditions above set forth have not been satisfied, it may declare this variance void and of no further effect.
