HomeMy WebLinkAboutCC RESO 8734RESOLUTION NO. 8734 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962 The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hard- ship, and a result inconsistent with the general purpose and intent of Ordinance No. 962 would occur through strict appli- cation of the provisions of said Ordinance to that certain real property hereinafter described. 2. That a Petition requesting a variance has been filed pursuant to the provisions of Section 12 of said Ordi- nance and said Petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Or- dinance No. 962 be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: All that portion of Lot 13 of HILLS OF PARADISE, ac- cording to the Map thereof No. 1860, filed in the office of the County Recorder of said San Diego County, September 23, 1925, lying Northerly of a line drawn parallel with and distant Nor- therly 145 feet measured at right angles from the Southerly line of said Lot 13, said Southerly line being a straight line bearing North 71° 33' East. 6. That the variance hereby granted is as follows: Permission to build a new, modern, fully equipped convalescent or rest home accomodating approximately fifty-two patients subject to the restrictions specified in paragraph 7. 7. That said variance is hereby granted upon the following conditions: (a) Applicants be permitted to construct and maintain a rest home and convalescent home provided patients are not treated for major mental sickness or disease as defined in the Zoning Ordinance. (b) Southerly portions of 9th Street adjacent to the north property line in accordance with the recommendation of the City Engineer. (c) One-half of all streets abutting said prop- erty to be improved as recommended by the City Engineer and in accordance with applicable City Ordinances. (d) A 40-foot entrance into property be provided from Paradise Drive as recommended by the Fire Inspector. (e) Driveways on property to be 20 feet wide, completely encompassing the entire building, capable of sup- porting fire equipment in excess of 25,000 pounds per unit as recommended by the Fire Inspector. (f) Curbs, gutter and sidewalks to be constructed on Paradise Drive. (g) Curbs, gutter and sidewalks to be constructed on East 9th Street. (h) Off-street parking be provided to accomodate twenty-eight cars. (i) Hydrant to be installed by the City adjacent to the entrance of the property on Paradise Drive as recommended by the Fire Inspector. (j) Reasonable buffer be provided between the residential development and the proposed development such as shrubbery or hedge, etc. 8. In the event that the City Council should here- after find and determine that the conditions above set forth have not been satisfied, it may declare this variance void and of no further effect.
