HomeMy WebLinkAboutCC RESO 8576RESOLUTION NO. 8576 RESOLUTION REGARDING UNINHABITED ANNEXATIONS The City Council of the City of National City, California does hereby resolve as follows: 1. That Resolution No. 8088 of the City of National City is hereby repealed. 2. That in any proceeding pending before the City Council of the City of National City wherein a petition has been filed seeking the annexation of uninhabited territory to the City of National City: A. The City Clerk is authorized and directed to cause written notice of such proposed annexation to be given to the San Diego County Board of Supervisors and to the governing body of any County Fire Protection District which has any in- terest in any structural improvement located on any portion of said property, and to cause written notice to be given to such other persons who may be legally entitled thereto in the manner required by law. B. In proceedings where the petition is signed or the consent has been filed by the owners of less than all of the land in the territory proposed to be annexed: (1) The City Clerk is further authorized and directed to cause a copy of the resolution giving notice of such proposed annexation to be published twice, but not oftener than once a week in a newspaper of general circulation published in the City and also in a newspaper of general cir- culation published outside the City, each said publication to be complete at least 20 days prior to the date set for the hearing, provided that such publication outside of National City shall not be required if the proceedings are initiated by petition of the owner or owners of all of the territory proposed to be annexed. (Government Code Section 35311) (2) The City Clerk is authorized and directed to cause written notice of such proposed annexation to be mailed not less than 20 days before the first public hearing to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to the City Clerk, and also to any person who has filed his name and address and the designation of the lands in which he has any interest, either legal or equitable, with the City Clerk. (Government Code Section 35311). C. In proceedings where the petition is signed or the consent has been filed by the owners of all of the land in the territory proposed to be annexed, the City Clerk is further authorized and directed to cause a copy of the resolu- tion to be published at least once in a newspaper of general circulation published in the City. Publication shall be com- plete at least four days prior to the date set for the hearing. (Government Code Section 35310.1). PASSED AND ADOPTED this 4 d- day of February, 1964. ATTEST:
