HomeMy WebLinkAboutCC RESO 8621RESOLUTION NO. 8621 RESOLUTION CONFIRMING EMPLOYMENT OF ATTORNEYS TO ASSIST IN SPECIAL ELECTION BE IT RESOLVED by the City Council of the City of National City, California as follows: That the employment of the law firm of O'Melveny & Myers is hereby confirmed for the purpose of the rendering of legal services relating to the Special Election on April 14, 1964, submitting special measures regarding general obligation bonds to the electors, such employment to be upon the terms stated in a letter dated March 5, 1964 to the City Council from the firm of O'Melveny & Myers, a copy which is attached and incorporated by reference. We will be happy to accept such employment. Our services will consist of the drafting of all ordinances, resolutions, notices and other documents re- quired in the bond proceedings, the general supervision of the proceedings, the examination of the proceedings step by step as taken, and the issuance of our approving opinion to the purchaser of the bonds. For these services our fee will be 2/l0th of 1% of the principal amount of the bonds authorized, payable one-half following the canvass of the election returns and the remainder following the sale of the bonds or any portion thereof. In the event there is more than one sale, there will be a fee of $100 for each sale following the first sale. In the event the bond proposition fails to carry at the election, our fee will be $750 payable following the canvass of the election returns. In addition, we are to be reimbursed on monthly statements for our out-of-pocket expenses for long distance telephone calla, telegrams and similar items.
