HomeMy WebLinkAboutCC RESO 8628RESOLUTION NO. 8628 RESOLUTION OF INTENTION (Laurel Avenue, Norton Avenue and First Street) The City Council of the City of National City, California, does hereby resolve, determine and order as follows: Section 1. The public interest and convenience require and it is the intention of the City Council of said City of Nation- al City to order the following work to be done or improvement to be made in the City of National City, to -wit: that LAUREL AVENUE NORTON AVENUE AND FIRST STREET be improved as follows: by the grading, paving and installation of type "G" curbs and that any other work auxiliary to any of the above and which may be re- quired to carry out the same, be performed. Section 2. The attention of all persons is directed to the fact that all of said classes of work above described may not be constructed upon all of the streets or public ways above mentioned in their entirety, but only upon the particular locations shown on the plans, specifications and drawings. Section 3. The estimated cost of said work, including incidental expenses, is the sum of $62,443.51. The City has budgeted a sum equal to 13.84% of the total project cost as a contribution toward the cost of said work. Section 4. All the aforesaid work or improvement shall be constructed at the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, specifications, profiles and drawings for the said work approved and adopted by this Council on April 7, 1964, by Resolution No. 8625. Said plans, specifications, profiles and drawings are on file in the office of the City Section 7. Serial bonds bearing interest at the rate of six percent (6%) per annum shall be issued to represent each assessment of fifty dollars ($50.00) or over remaining unpaid for thirty (30) days after the date of recordation of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September 1 following their date. Said bonds shall be payable to bearer and there shall be added after the redemption clause in the bond the following language, "to- gether with a premium of five percent (5%) of said unmatured principal." Said bonds are to be issued pursuant to and as provided in the Improvement Act of 1911, Division 7 of the Streets and Highways Code of the State of California. Section 8. The said proposed work is to be done under and proceedings therefore are to be under and pursuant to the said Improvement. Act of 1911. Section 9. Notice is hereby given that the 19th day of May, 1964, at the hour of 8:00 o'clock p.m. are the day and hour when, and the Council Chambers of this City Council in the City Hall in the City of National City is thi place where, any and all persons having any protest or objection to said proposed work or to the extent of said assessment district, or to the proposed grades, may appear beforethe City Council of the City of National City and show cause why said proposed work should not be carried out in accordance with this Resolu- tion of Intention. Protests or objections must be in writing and must be delivered to the City Clerk of said City of National City not later than the hour herein set for hearing protests or objections. Clerk of the City of National City in the City Hall of said City, and reference is hereby made to said plans, specifications, profiles and drawings for a full aril/detailed description of said proposed work and for a descriptionof the grades at which said work is to be done. Said grades are hereby adopted and established as the official grades for all purposes in connection with pro- ceedings pursuant to this Resolution of Intention. Notice is hereby given that said grades may be new and different from those heretofore established or existing, or may be, and in some cases are, different from existing ground levels. Section 5. In the opinion of this City Council, the said contemplated work is of more than local or ordinary public benefit and this City Council hereby makes the expense of said work chargeable upon a district, which district this City Council hereby declares to be the district benefited by the said work and to be assessed to pay the cost and expenses thereof. For a description of said district, reference is hereby made to a plat or map of said district heretofore approved by this City Council on file in the office of the City Clerk and designated as "PLAT FOR IMPROVEMENT OF PROPOSED ASSESSMENT DISTRICT NO. 135 FOR THE IMPROVEMENT OF LAUREL AVENUE, NORTON AVENUE AND FIRST STREET." This map or plat indicates by a boundary line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. Section 6. All public streets or public parks, and all easements or rights of way belonging to the public, and also all property owned by the United States of America or the State of California now in use in the performance of a public function are hereby specifically excluded from this assessment district. Section 10. The report of the City Engineer pur- suant to the provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, and the report of the City Manager and the City Engineer of the hearing on said report are on file with the City Clerk of National City and may be examined in her office. Section 11. The National City Star News is hereby selected as the newspaper in which this resolution shall, be published and in which all other(publications regarding the proceedings pursuant to this Resolution of Intention shall be made. The City Clerk is hereby directed to certify to the adoption of this resolution and to cause said resolution to be published in the manner provided by law. Section 12. The City Clerk is hereby directed to mail notices of the adoption of this resolution as provided in said Improvement Act of 1911, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the cost of said work whose names and addresses appear on the last equalized assessment roll or as known to the City Clerk. Section 13. The Street Superintendent of the City of National City is hereby dieted to cause to be conspicuously posted along the line of the contemplated work and on all open streets within the said assessment district notices of the pass- age of this Resolution of Intention in the time, form and manner provided by law.
