HomeMy WebLinkAboutCC RESO 8659RESOLUTION NO. 8659 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO.962 The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hard- ship, and a result inconsistent with the general purpose and intent of Ordinance No. 962 would occur through strict appli- cation of the provisions of said Ordinance to that certain real property hereinafter described. 2. That a Petition requesting a variance has been filed pursuant to the provisions of ; >ection 12 of said Ordi- nance and said Petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. That a variance from the provisions of said Ordinance No. 962 be and hereby is granted with reference to allthe certain real property situated in the City of Nation- al City, California, more particularly described as follows: Lot 10 in Block 1 of T. Parson's Subdivision of 10 Acre Lot 8, in Quarter Section 155 of Rancho de la Nacion, in the City of National City, County of San Diego, State of California, according to Map thereof No. 57, filed in the Office of the County Recorder of San Diego County, April 26, 1881; excepting therefrom the southerly 3 feet more or less being more particularly described as all that portion of said Lot 10 lying south of the Post Office Building as erected in the year 1942 together with the southerly 3 feet of the portion of said Lot lying westerly of said Post Office Building, as granted for L. E. C. Smith and Ada R. Smith husband and wife, as joint tenants in deed recorded February 24, 1943 as Document No. 10212. 6. That the variance hereby granted is as follows: Permission to operate and maintain a wholesale grocery ware- house subject to the restrictions specified in paragraph 7. 7. That said variance is hereby granted upon the following conditions: (a) That all loading and unloading be done from the rear of the building only. (b) That all trucks, cars, etc., operating from this business be parked off street during non -working hours. (c) That no fresh food processing be allowed. (d) That off street parking be provided as required by the Zoning Ordinance. 8. In the event that the City Council should hereafter find and determine that the conditions above set forth have not been satisfied, it may declare this variance void and of no further effect.
