RESOLUTION OF INTENTION
(17th Street from "J" Avenue to
"L to
Avenue)
The City Council of the City of National City, Cal-
ifornia, does hereby resolve, determine and order as follows:
Section 1: The public interest and convenience re-
quire and it is the intention of the City Council of said City
of National City to order the following work to be done or im-
provement to be made in the City of National City, to -wit: that
17TH STREET FROM "J" AVENUE TO "L" AVENUE be improved as follows:
by the removal items, construction of curb and gutter, and pav-
ing, and that any other work auxiliary to any of the above and
which may be required to carry out the same, be performed.
Section 2: The attention of all persons is directed
to the fact that all of said classes of work above described
may not be constructed upon all of the streets or public ways
above mentioned in their entirety, but only upon the particular
locations shown on the plans, specifications and drawings.
Section 3: The estimated cost of said work, includ-
ing incidental expenses, is the sum of $14.,320.00. The City of
National City has budgeted the sum of $1,280.00 as a contribu-
tion to said cost. The said City hereby agrees that the said
sum of $1,280.00 shall be paid to the contractor as a contri-
bution to said cost.
Section 4: All the aforesaid work or improvement
shall be constructed at the grades, along the lines, between
the points, of the dimensions, at the places and in the manner
shown on the plans, specifications, profiles and drawings for
the said work approved and adopted by this Council on December
27, 1963, by Resolution No. 8544. Said plans, specifications,
profiles and drawings are on file in the office of the City
Clerk of the City of National City in the City Hall of said
City, and reference is hereby made to said plans, specifications,
profiles and drawings for a full and detailed description of said
proposed work and for a description of the grades at which said
work is to be done. Said grades are hereby adopted and established
as the official grades for all purposes in connection with
proceedings pursuant to this Resolution of Intention. Notice
is hereby given that said grades may be new and different from
those heretofore established or existing, or may be, and in some
cases are, different from existing ground levels.
Section 5: In the opinion of this City Council, the
said contemplated work is of more than local or ordinary pub-
lic benefit and this City Council hereby makes the expense of
said work chargeable upon a district, which district this City
Council hereby declares to be the district benefited by the
said work and to be assessed to pay the cost and expenses
thereof. For a description of said district, reference is
hereby made to a plat or map of said district heretofore approved
by this City Council on file in the office of the City Clerk and
designated as "PLAT OF PROPOSED ASSESSMENT DISTRICT FOR LHE IM-
PROVEMENT OF SEVENTEENTH FROM "J" AVENUE TO "L" AVENUE; ALL IN
THE CITY OF NATIONAL CITY, CALIFORNIA.' This map or plat in-
dicates by a boundary line the extent of the territory included
in the said proposed district and shall govern for all details
as to the extent of said assessment district.
Section 6: All public streets or public parks, and
all easements or rights of way belonging to the public, and
also all property owned by the United States of America or the
State of California now in use in the performance of a public
function are hereby specifically excluded from this assessment
district.
Section 7: Serial bonds bearing interest at the rate
of six percent (6%) per annum shall be issued to represent each
assessment of fifty dollars ($50.00) or over remaining unpaid
for thirty (30) days after the date of recordation of the war-
rant. Said serial bonds shall extend over a period ending nine
(9) years from the second day of January next succeeding the
next September 1 following their date. Said bonds shall be pay-
able to bearer and there shall be added after the redemption
clause in the bond the following language, "together with a
premium of five percent (5%) of said unmatured principal."
Said bonds are to be issued pursuant to and as provided in the
Improvement Act of 1911, Part 5, Division 7, Chapter 4, Section
6464, of the Streets and Highways Code of the State of California.
Section 8: The said proposed work is to be done under
and proceedings therefore are to be under and pursuant to the
said Improvement Act of 1911.
Section 9: Notice is hereby given that on the 4th
day of February, 1964, at the hour of 8:00 otclock p.m. are the
day and hour when, and the Council Chambers of this City Council
in the City Hall in the City of National City is the place where,
any and all persons having any protest or objection to said pro-
posed work or to the extent of said assessment district, or to
the proposed grades,may appear before the City Council of the
City of National City and show cause why said proposed work
should not be carried out in accordance with this Resolution of
Intention. Protests or objections must be in writing and must
be delivered to the City Clerk of said City of National City
not later than the hour herein set for hearing protests or ob-
jections.
Section 10: The report of the City Engineer pursuant
to the provisions of the Special Assessment Investigation, Limit-
ation and Majority Protest Act of 1931, and the report of the
City Manager and the City Engineer of the hearing on said report
will be on file with the City Clerk of National City and may be
examined in her office.
Section 11: The National City Star News is hereby
selected as the newspaper in which this resolution shall be
published and in which all other publications regarding the
proceedings pursuant to this Resolution of Intention shall be
made. The City Clerk is hereby directed to certify to the
adoption of this resolution and to cause said resolution to be
published in the manner provided by law.
Section 12: The City Clerk is hereby directed to
mail notices of the adoption of this resolution as provided in
said Improvement Act of 1911, postage prepaid, to all persons
owning real property which is proposed to be assessed to pay
any part of the cost of said work whose names and addresses
appear on the last equalized assessment roll or as known to
the City Clerk.
Section 13: The Street Superintendent of the City
of National City is hereby directed to cause to be conspicu-
ously posted along the line of the contemplated work and on
all open streets within the said assessment district notice
of the passage of this Resolution of Intention in the time,
form and manner provided by law.
