RESOLUTION OF INTENTION
(2nd Street East of Harbison Avenue)
The City Council of the City of National City, Cal-
ifornia, does hereby resolve, determine and order as follows:
Section 1: The public interest and convenience re-
quire and it is the intention of the City Council of said City
of National City to order the following work to be done or im-
provement to be made in the City of National City, to -wit:
that 2ND STREET EAST OF HARBISON AVENUE be improved as follows:
by the removal items, construction of curb and gutter, and pav-
ing, and that any other work auxiliary to any of the above and
which may be required to carry out the same, be performed.
Section 2: The attention of all persons is directed
to the fact that all of said classes of work above described
may not be constructed upon all of the streets or public ways
above mentioned in their entirety, but only upon the particular
locations shown on the plans, specifications and drawings.
Section 3: The estimated cost of said work, includ-
ing incidental expenses, is the sum of $8,800.00. The City of
National City has budgeted the sum of $1,690.00 as a contribu-
tion to said cost. The said City hereby agrees that the said
sum of $1,690.00 shall be paid to the contractor as a contri-
bution to said cost.
Section 4: All the aforesaid work or improvement
shall be constructed at the grades, along the lines, between
the points, of the dimensions, at the places and in the manner
shown on the plans, specifications, profiles and drawings for
the said work approved and adopted by this Council on December
27, 1963, by Resolution No. 8549 . Said plans, specifications,
profiles and drawings are on file in the office of the City
Clerk of the City of National City in the City Hall of said
City, and reference is hereby made to said plans, specifica-
tions, profiles and drawings for a full and detailed descrip-
tion of said proposed work and for a description of the grades
at which said work is to be done. Said grades are hereby
adopted and established as the official grades for all pur-
poses in connection with proceedings pursuant to this Reso-
luction of Intention. Notice is hereby given that said
grades may be new and different from those heretofore estab-
lished or existing, or may be, and in some cases are, dif-
ferent from existing ground levels.
Section 5: In the opinion of this City Council,
the said contemplated work is of more than local or ordinary
public benefit and this City Council hereby makes the expense
of said work chargeable upon a district, which district this
City Council hereby declares to be the district benefited by
the said work and to be assessed to pay the cost and expenses
thereof. For a description of said district, reference is
hereby made to a plat or map of said district heretofore ap-
proved by this City Council on file in the office of the City
Clerk and designated as "PLAT OF PROPOSED ASSESSMENT DISTRICT
FOR THE IMPROVEMENT OF SECOND ST. FROM HARBISON AVE. EAST TO
TERMINATION; ALL IN THE CITY OF NATIONAL CITY, CALIFORNIA."
This map or plat indicates by a boundary line the extent of
the territory included in the said proposed district and shall
govern for all details as to the extent of said assessment
district.
Section 6: All public streets or public parks, and
alleasements or rights of way belonging to the public, and
also all property owned by the United States of America or the
State of California now in use in the performance of a public
function are hereby specifically excluded from this assessment
district.
Section 7: Serial bonds bearing interest at the rate
of six percent (6%) per annum shall be issued to represent each
assessment of fity dollars ($50.00) or over remaining unpaid
for thirty (30) days after the date of recordation of the war-
rant. Said serial bonds shall extend over a period ending nine
(9) years from the second day of January next succeeding the
next September 1 following their date. Said bonds shall be
payable to bearer and there shall be added after the redemption
clause in the bond the following language, "together with a
premium of five percent (5%) of said unmatured principal."
Said bonds are to be issued pursuant to and as provided in the
Improvement Act of 1911, Part 5, Division 7, Chapter 4, Section
6464,of the Streets and Highways Code of the State of California.
Section 8: The said proposed work is to be done under
and proceedings therefore are to be under and pursuant to the
said Improvement Act of 1911.
Section 9: Notice is hereby given that on the 4th
day of February, 1964, at the hour of 8:15 o'clock p.m. are
the day and hour when, and the Council Chambers of this City
Council in the City Hall in the City of National City is the
place where, any and all persons having any protest or objection
to said proposed work or to the extent of said assessment dis-
trict, or to the proposed grades, may appear before the City
Council of the City of National City and show cause why said
proposed work should not be carried out in accordance with this
Resolution of Intention. Protests or objections must be in
writing and must be delivered to the City Clerk of said City of
National City not later than the hour herein set for hearing
protests or objections.
S<-ction 10: The report of the City Engineer pursuant
to the provisions of the Special Assessment Investigation, Lim-
itation and Majority Protest Act of 1931, and the report of the
City Manager and the City Engineer of the hearing on said re-
port will be on file with the City Clerk of National City and
may be examined in her office.
Section 11: The National City Star News is hereby
selected as the newspaper in which this resolution shall be
published and in which all other publications regarding the
proceedings pursuant to this Resolution of Intention shall be
made. The City Clerk is hereby directed to certify to the
adoption of this resolution and to cause said resolution to be
published in the manner provided by law.
Section 12: The City Clerk is hereby directed to
mail notices of the adoption of this resolution as provided in
said Improvement Act of 1911, postage prepaid, to all persons
owning real property which is proposed to be assessed to pay
any part of the cost of said work whose names and addresses
appear on the last equalized assessment roll or as known to
the City Clerk.
Section 13: The Street Superintendent of the City
of National City is hereby directed to cause to be conspicu-
ously posted along the line of the contemplated work and on
all open streets within the said assessment district notice
of the passage of this Resolution of Intention in the time,
form and manner provided by law.
