HomeMy WebLinkAboutCC RESO 8444RESOLUTION NO. 8444 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCES NO. 962 AND 981 The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hardship and a result in- consistent with the general purpose and intent of Ordinance No. 962 would occur through strict application of the provisions of said Ordinance to that certain real property hereinafter described. 2. That a petition requesting a variance has been filed pursuant to the provisions of Section 12 of said Ordinance and said petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property here- inafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Ordinance No. 962 be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: The Northerly 100 feet of the Southerly 140 feet of the Easterly 150 feet of the Westerly 180 feet of 80 Acre Lot 1, Quarter Section 130, Rancho de la Nacion, according to the Map thereof No. 166 on file in the Recorder's Office of San Diego County, California. (Northeast Corner of 4th Street and Palm Avenue). 6. That the variance hereby granted is as follows: Permission to install and maintain one identification sign in excess of the total aggregate area permitted within a C-2, Limited Commercial Zone. 7. That said variance is hereby granted upon the following conditions: a. That the sign shall not exceed 150 square feet in aggregate area. b. That said sign shall be located 75 feet from the northwest corner of the subject property. ;. That said sign shall be located 8 feet from the southerly property line to permit all portions of the sign to lie within the subject property. d. That the bottom molding of said sign shall not be located closer than 16 feet from grade level. 8. In the event that the City Council should hereafter find and deter- mine that the conditions above set forth have not been satisfied, it may declare this variance void and of no further effect.
