RESOLUTION AUTHORIZING MAYOR TO EXECUTE AN AGREEMENT
FOR SALE OF VACANT SCHOOL BUILDING
BE IT RESOLVED by the City Council of the City of
National City that the Mayor of National City be and is hereby
authorized to execute an agreement with F. E. MC CORM!CK
for the sale of that certain building located at 211 W. 29th
Street in the City of National City.

AGREEMENT
For and in consideration of the sum of One Dollar
(51.00; paid to the City of National City, a Municipal Corpora-
tion, receipt of which is hereby acknowledged, City of National
City hereby sells to F. E. MC CORMICK, hereinafter referred to
as Buyer, as personal property, that certain building located
at 211 W. 29th Street in the City of National City, and commonly
referred to as the Nursery School.
This sale is made upon the following express terms
and conditions which buyer agrees faithfully to perform:
1. Buyer agrees to disassemble all of said building
and to remove the salvage resultant therefrom, and to clear the
area of all salvage except concrete slab.
2. Buyer agrees to begin such performance on or
before rive (5) days from the date of signing the contract agree-
ment by both parties, and to complete said performance, including
demolition, removal and clearing by the 90th day after such agreed
beginning date, unless the completion date is extended by written
agreement of the parties hereto.
3. No burning shall be permitted on site.
4. All materials resulting from the disassembling of
said building which buyer is obligated hereunder to remove or
clear from the site, but which materials buyer does not desire
to keep, shall at buyer's sole cost and expense be removed to an
area to be designated by the Housing Director of the City of
National City.
5. Buyer shall post with the City Clerk a surety bond
in a form satisfactory to the City of National City in the sum of
$1,000.00 posted by a corporation authorized to do business in
the State of California to guarantee the faithful performance of
the covenants and conditions made on the part of buyer pursuant
to the terms and conditions of this agreement. Buyer shall
have nc right to begin performance hereunder until such bond is
posted; however, a delay in the posting of such bond shall in
no way extend the final completion date hereunder.
6. Buyer agrees that he shall hold the City of
National City, its officers and agents and employees free and
harmless to the full extent of any liability which may result
to them as a consequence of buyer's acts or omissions in perform-
ing the demolition, removal and clearing hereunder. Buyer shall
furnish to the City Clerk prior to beginning performance under
this contract, certificates of insurance evidencing that buyer
has pubic liability insurance of at least S100,000.00 per per-
son and
300,000.00 per occurance, and property damage of not
less than )25,000.00, such certificates also showing City of
National City as co-insured.
7. It is mutually agreed that time is of the essence
of this agreement.
