HomeMy WebLinkAboutCC RESO 8199RESOLUTION NO. 8199 A RESOLUTION RELINQUISHING RIGHTS RETAINED BY CITY COUNCIL RELATIVE TO USES OF KIMBALL PARK Be it resolved by the City Council of the City of National City as follows: 1. That all of the rights, reservations and uses for other than park purposes specifically reserved by the City Council for Kimball Park in Resolution No. 6159, are hereby waived and released and relinquished, except for the following rights and reservations which are specifically reserved to wit: (a) The right to erect and maintain buildings for public park and recreation purposes designed for the recre- ation, pleasure and enjoyment of the community, specifically including but not limited to, public library buildings. (b) The right to erect and maintain structures to be used for recreation, fallout shelter, recovery or recep- tion area as defined under the Civil Defense Program. (c) The right to use in its entirety or any portion thereof for recovery or reception areas as defined by the Civil Defense Program. (d) The right to erect and maintain public parking areas, zoos, aviaries, playgrounds and athletic fields. (e) The right to erect and maintain wells and pumping stations. (f) The right to construct and maintain roads and streets for public use when needed subject to the approval of the City Council after having considered the recommendations of the Planning Commission, Park and Recreation Advisory Board and Park Superintendent. 2. It is hereby specifically provided that the real property herein dedicated and declared as a public park, or any potion thereof shall not be sold, transferred or conveyed, or used for any purpose other than park purposes or further uses as are here specifically reserved herein above in this resolution, except upon compliance with the provisions of Title 4, Division 3, Part 2, Chapter 9 Article 2, or any amendments thereto, of the Government Code of the State of California.
