A RESCLUTION DETERMINING AND DECLARING THAT TEE PUBLIC INTEREST,
CONVENIENCE AND NECESSITY OF THE CITY OF NATIONAL CITY REQUIRE
THE CONSTRUCTION, OPERATION AND MAINTENANCE OF PUBLIC STREET
ACROSS CERTAIN DESCRIBED LAND IN ThE CITY OF NATIONAL CITY,
COUNTY OF SAN DIEGO, STATE OF CALIFORNIA; AND THAT THE PUBLIC
INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF
FEE TITLE TO SAID PROPERTY TO 3E USED BY SAID CITY FOR SAID
PURPOSE; AND DECLARING TEE INTENTION OF THE CITY OF NATIONAL
CITY TO ACQUIRE SAID PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS;
AND DIRECTING THE CITY ATTCRNEY OF THE CITY OF NATIONAL CITY TO
COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIF-
ORNIA IN AND FOR ThE COUNTY OF SAN DIEGO FOR THE PURPOSE OF
ACQUIRING SAID PROPERTY, AND DIRECTING THE CITY ATTORNEY OF TEE
CITY OF NATIONAL CITY TO NEGOTIATE WITH QUALIFIED REAL ESTATE
APPRAISERS AND TO SUBMIT A PROPOSED AGREEMENT TO THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY FOR SERVICES TO BE PERFORMED BY
QUALIFIED APPRAISER IN SAID EMINENT DOMAIN PROCEEDINGS.
BE IT RESOLVED, by the Council of the City of National
City as follows:
SECTION 1: That the public interest, convenience and
necessity of the City of National City and the inhabitants thereof
require the construction., operation and maintenance of public
streets across those two parcels of real property identified as
Parcels 1 and 2 herein, located in the City of National City,
County of San Diego, State of California and fully described in.
Exhibit "A" hereto, which said exhibit is attached hereto and by
this reference incorporated herein and made a part hereof as
though set forth in. full,
SECTION 2: That the public interest, convenience, and
necessity of said City and inhabitants thereof demand the acqui-
sition and taking of fee title to said property for the construc-
tion, .operation and maintenance of the aforesaid public streets
lying within the City of National City, County of San Diego,
State of California,
SECTION 3: That the property to be condemned, being
Parcels 1 and 2, are fully described in Exhibit "A" attached
hereto and incorporated by reference in Section. 1 above,
SECTION 4: That the taking and acquiring by said City
of the property described in Exhibit "A" hereto is deemed neces-
sary for the construction, operation and maintenance of said

public streets by the City of National City and the inhabitants
thereof for municipal purposes; that such uses are public uses
and that for such public uses it is necessary that the City of
National City condemn and acquire the property herein above
described; that the property herein above described is to be
used for the construction, operation and maintenance of the said
public streets,
SECTION 5: That the City Attorney of the City of
National City be and he is hereby authorized and directed to
commence an actionin. the Superior Court of the State of Calif-
ornia in and for the County of San Diego, in the name and on.
behalf of the City of National City against all owners and
claimants of the above described property for the purpose of
condemning and acquiring said property for the use of said City,
SECTION 6: That the City Attorney of the City of
National City be and he is hereby further authorized and directed
to negotiate with qualified real estate appraisers for the pur-
pose of implementing said eminent domain proceedings by obtaining
a valid appraisal of the real property to be condemned; and, that
the Ci_y Attorney be authorized to submit for approval by this
Council a retainer agreement providing for the .services and com-
pensation of a qualified appraiser.
