RESOLUTION GRANTING ZONE VARIANCE
PURSUANT TO ORDINANCE NO. 962
The City Council of the City of National City does hereby find, determine,
order and resolve as follows:
1. That practical difficulties, unnecessary hardship, and a result incon-
sistent with the general purpose and intent of Ordinance No. 962 would occur
through strict application of the provisions of said Ordinance to that certain
real property hereinafter described.
2. That a Petition requesting a variance has been filed pursuant to the
provisions of Section 12 of said Ordinance and said Petition complies with all
the requirements of said section.
3. That the National City Planning Commission did hold a hearing on said
Petition and did recommend to the City Council that a variance be granted.
4. That the granting of a variance with reference to the property here-
inafter described will not defeat, but rather will carry out the general intent
and purpose of the National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said Ordinance No. 962 be and
hereby is granted with reference to all the certain real property situated in
the City of National City, California, more particularly described as follows:
The Westerly 64 feet of Lots 9 and 10, Block 2, Budd Villa Tract, Map No.
1067, and closed portion of A Avenue lying adjacent to the Westerly line of
said Lots 9 and 10, and all the Southerly 40 feet of the Easterly 104 feet of
the Westerly 434 feet of Lot 6, Quarter Section 152, Rancho de la Nacion,
Map No. 166, all according to maps on file in the County Recorder's Office of
San Diego County.
6. That the variance hereby granted is as follows:
Permission for the operation by the County of San Diego of a sanitary
landfill on the above described property for a period not to exceed one month.
7. That said variance is hereby granted upon the following conditions:
(a) That no portion of the sewer easement extending across the above
described property shall be covered with any materials other than solid earth.
(b) That all refuse placed within said fill shall be completely
covered daily by solid earth.
(c) That any drainage facilities installed within said fill and all
other fills adjacent to said described property shall be installed as approved
by the City Engineer for the City of National City.
(d) That said sanitary fill shall be installed and completed as
approved by the City Engineer of the City of National City.
(e) That all existing manhole frames shall be raised to level of the
entire filled area.
8. In the event that the City Council should hereafter find and determine
that the conditions above set forth have not been satisfied, it may declare
this variance void and of no further effect.
