(HIGHLAND AVENUE - DIVISION STREET TO FOURTH STREET AND
EIGHTEENTH. STREET TO THIRTIETH STREET)
The City Council of the City of National City,
California, does hereby resolve, determine and order as follows:
§I. The public interest and convenience require and
it is the intention of the City Council of said City of National
City to order the following work to be done or improvement to be
made in the City of National City, to wit: that Highland Avenue
- Division Street to Fourth Street and Eighteenth Street to
Thirtieth Street be imprhoved as follows: by the removal of con-
crete sidewalks, curbs and driveways, tree removal, the prepara-
tion of subgrade and the paving of portions of streets, the con-
struction of standard type G' curbs concrete cross gutters,
sidewalks and curbs, and that any other work auxiliary to any
of the above and which may be required to carry out the same,
be performed.
§2. The attention of all persons is directed to the
fact that all of said classes of work above described may not
be constructed upon all of the streets or public ways above
mentioned in their entirety, but only upon the particular loca-
tions shown on the plans, specifications and drawings.
§3. The estimated cost of said work, including in-
cidental expenses, is the sum of $152,271.01. The City of
National City has budgeted the sum of $77,212.00 as a contri-
bution to said cost. The said City hereby agrees that said
sum of $77,212.00, or a sum equal to 50.70% of the actual cost
of said work of improvement, whichever sum is the lesser, shall
be paid to the contractor as a contribution to said cost.
§4. All the aforesaid work or improvement shall be
constructed at the grades, along the lines, between the points,
of the dimensions, at the places and in the manner shown on
the plans, specifications, profiles and drawings for the said
work approved and adopted by this Council on October 30, 1962
by Resolution No. 8223 . Said plans, specifications, profiles
and drawings are on file in the office of the City Clerk of the
City of National City in the City Hall of said City, and
reference is hereby made to said plans, specifications, profiles
and drawings for a full and detailed description of said pro-
posed work and for a description of the grades at which said
work is to be done. Said grades are hereby adopted and estab-
lished as the official grades for all purposes in connection
with proceedings pursuant to this Resolution of Intention.
Notice is hereby given that said grades may be new and differ-
ent from those heretofore established or existing, or may be,
and in some cases are, different from existing ground levels.
§5. In the opinion of this City Council, the said
contemplated work is of more than local or ordinary public
benefit and this City Council hereby makes the expense of said
work chargeable upon a district, which district this City
Council hereby declares to be the district benefited by the
said work and to be assessed to pay the cost and expenses
thereof. For a description of said district, reference is
hereby made to a plat or map of said district heretofore approved
by this City Council on file in the office of the City Clerk and
designated es "MAP OF PROPOSED ASSESSMENT DISTRICT FOR THE IM-
PROVEMENT OF HIGHLAND AVENUE BETWEEN DIVISION STREET AND FOURTH
STREET, EIGHTEENTH STREET AND THIRTIETH STREET AND PORTIONS OF
INTERSECTIONS THEREOF". This map or plat indicates by a boundary
line the extent of the territory included in the said proposed
district and shall govern for all details as to the extent of
said assessment district.
§6. All public streets or public parks, and all ease-
ments or rights of way belonging to the public, and also all
property owned by the United States of America or the State of
California now in use in the performance of a public function
are hereby specifically excluded from this assessment district.
§7. Serial bonds bearing interest at the rate of six
percent (6%) per annum shall be issued to represent each assess-
ment of fifty dollars ($50.00) or over remaining unpaid for
thirty (30) days after the date of recordation of the warrant.
Said serial bonds shall extend over a period ending nine (9)
years from the second day of January next succeeding the next
September 1 following their date. Said bonds shall be payable
to bearer and there shall be added after the redemption clause
in the bond the following language, "together with a premium of
five percent M0) of said unpaid principal." Said bonds are to
be issued pursuant to and as provided in the Improvement Act of
1911, Division 7 of the Streets and Highways Code of the State
of California.
§8. The said proposed work is to be done under and
proceedings therefore are to be under and pursuant to the said
Improvement Act of 1911.
§9. Notice is hereby given that the 22nd day of
January, 1963, at the hour of 8:00 o'clock p.m. are the day and
hour when, and the Council Chambers of this City Council in the
City Hall in the City of National City is the place where, any
and all persons having any protest or objection to said proposed
work or to the-e'xtent.of sa.id.assessment district, or to the
proposed grades, may appear before the City Council of the City
of National City and show cause why said proposed work should
not be carried out in accordance with this Resolution of Inten-
tion. .Protests or objections must be in writing and must be
delivered to the City Clerk of said City of National City not
later than the hour herein set for hearing protests or objections.
§10. The report of the City Engineer pursuant to the
provisions of the Special Assessment Investigation, Limitation
and Majority Protest Act of 1931, and the report of the City
Manager and the City Engineer of the hearing on said report are
on file with the City Clerk of National City and may be examined
in her office.
§II. The National City Star News is hereby selected
as the newspaper in which this resolution shall be published
and in which all other publications regarding the proceedings
pursuant to this Resolution of intention shall be made. The
City Clerk is hereby directed to certify to the adoption of
this Resolution and to cause said Resolution to be published
in the manner provided by law.
§I2. The City Clerk is hereby directed to mail
notices of the adoption of this resolution as provided in
said Improvement Act of 1911, postage prepaid, to all persons
owning real property which is proposed to be assessed to pay
any part of the cost of said work whose names and addresses
appear on the last equalized assessment roll or as known to
the City Clerk.
i§13. The Street Superintendent of the City of
National City is hereby directed to cause to be conspicuously
posted along the line of the contemplated work and on all
open streets within the said assessment district notices of
the passage of this Resolution of Intention in the time, form
and manner provided by law.
