HomeMy WebLinkAboutCC RESO 8120RESOLUTION NO. 8120 RESOLUTION OF CONSENT AUTHORIZING THE CALLING OF AN ELECTION FOR THE FORMATION OF A SAN DIEGO UNIFIED PORT DISTRICT AND REQUESTING CERTAIN STUDIES BY THE BOARD OF SUPERVISORS. WHEREAS, a certain bill entitled Senate Bill No. 41, relative to the establishment of a San Diego Unified Port District has been passed by the legislature in the 1962 first extraordinary session, and WHEREAS, the City Council of the City of National City believes that there is not sufficient information available to voters in connection with the problem of the establishment of a port district, and WHEREAS, the City Council of the City of National City reaffirms its policy and desire to cooperate with the legislature, and the other legislative bodies involved in establishing a proper San Diego Port Authority, NOW, THEREFORE, BE IT RESOLVED as follows: 1. That the Council of the City of National City hereby authorizes the Board of Supervisors of San Diego County to call for an election for the formation of the San Diego Unified Port District upon the following conditions being satisfied: (a) That the Board of Supervisors conduct a study to determine what areas of the county other than the five (5) cities contiguous to the bay should be included in a San Diego Unified Port District (including incorporated areas as well as unincorporated areas). (b) That the Board of Supervisors conduct a financial study relative to the present status of port facilities, such study to include a complete report upon all outstanding bonded indebtedness relative to harbor and bay improvements. Such report should state how such indebtedness is to be retired, whether from taxes or some particular revenue, or otherwise. Such report -1- should also indicate what the present revenues of bay and port improvements are, itemized as to the particular improvements, and also the present operating expenses of all harbor operations and the actual tax rate, and taxes collected which are used in connection with the harbor operations. (c) That the Board of Supervisors conduct a study regarcing what appears to be deficiencies in the present law as passed by the legislature in that: (1) Only the five (5) contiguous cities and unin- corporated areas which "are economically linked to the develop- ment and operation of the Bay of San Diego" can be included in the district. (2) No other incorporated area in the County of San Diego can be included by the terms of the present bill. (3) Although the bill provides that an unincorporated area may be included in the district, the bill does not provide for ary vote by the people of such unincorporated area upon its inclusion, nor does the bill provide for any representation from the Bcard of Supervisors or from such unincorporated territory on the Board of Port Commissioners. (4) While the Board of Supervisors makes the actual levy (Section 49.5, page 12, line 1), the amount of money to be raised is determined by the Board of Harbor Commissioners (Section 49, page 11, line 46), and the act of levying a tax to raise this amount becomes merely ministerial. (d) That the results of the foregoing studies, together with recommendations, be made available to the interested parties and tc the public within a reasonable time prior to the calling of an election. -2- 2. That the City Manager is hereby authorized and directed to file with the Board of Supervisors of San Diego County a copy of this resolution and a communication requesting that the foregoing studies be made.
