(Grove Street From Sixteenth Street to Eighteenth Street)
The City Council of the City of National City, California, does
hereby resolve, determine and order as follows:
§1. The public interest and convenience require and it is the
intention of the City Council of said City of National City to order the follow-
ing work to be done or improvement to be made in the City of National City,
to wit: that Grove Street from Sixteenth Street to Eighteenth Street be
improved as follows: by the grading of portions of streets, the preparation
of subgrade and paving of portions of streets, the construction of Type G
curb, the construction of cross gutter, and the resetting of manholes to
grade, and that any other work auxiliary to any of the above and which may
be required to carry out the same, be performed.
§2. The attention of all persons is directed to the fact that all
of said classes of work above described may not be constructed upon all of
the streets or public ways above mentioned in their entirety, but only upon
the particular locations shown on the plans, specifications and drawings.
§3. The estimated cost of said work, including incidental
expenses, is the sum of $11, 423.00. The City of National City has budgeted
the sum of $382. 36 as a contribution to said cost. The said City hereby
agrees that said sum of $382. 36, or a sum equal to 2. 86% of the actual cost
of said work of improvement, whichever sum is the lesser, shall be paid to
the contractor as a contribution to said cost.
§4. All the aforesaid work or improvement shall be constructed
at the grades, along the lines, between the points, of the dimensions, at the
places and in the mariner shown on the plans, specifications, profiles and
drawings for the said work approved and adopted by this Council on April 17,
1962 by Resolution No. 8102. Said plans, specifications, profiles and draw-
ings are on file in the office of the City Clerk of the City of National City in
the City Hall of said City, and reference is hereby made to said plans,
specifications, profiles and drawings for a full and detailed description of
said proposed work and for a description of the grades at which said work is
to be done. Said grades are hereby adopted and established as the official
grades for all purposes in connection with proceedings pursuant to this
Resolution of Intention. Notice is hereby given that said grades may be new
and different from those heretofore established or existing, or may be, and
in some cases are, different from existing ground levels.
§5. In the opinion of this City Council, the said contemplated
work is of more than local or ordinary public benefit and this City Council
hereby makes the expense of said work chargeable upon a district, which
district this City Council hereby declares to be the district benefited by the
said work and to be assessed to pay the cost and expenses thereof. For a
description of said district, reference is hereby made to a plat or map of
said district heretofore approved by this City Council on file in the office of
the City Clerk and designated as "MAP OF PROPOSED ASSESSMENT
DISTRICT FOR THE IMPROVEMENT OF GROVE STREET FROM
SIXTEENTH STREET TO EIGHTEENTH STREET; and PORTIONS OF INTER-
SECTIONS THEREOF." This map or plat indicates by a boundary line the
extent of the territory included in the said proposed district and shall govern
for all details as to the extent of said assessment district.
§6. All public streets or public parks, and all easements or
rights of way belonging to the public, and also all property owned by the
United States of America or the State of California now in use in the perfor-
mance of a public function are hereby specifically excluded from this assess-
ment district.
§7. Serial bonds bearing interest at the rate of six per cent
(6%) per annum shall be issued to represent each assessment of fifty dollars
($50.00) or over remaining unpaid for thirty (30) days after the date of
recordation of the warrant. Said serial bonds shall extend over a period
ending nine (9) years from the second day of January next succeeding the
next September 1 following their date. Said bonds are to be issued pursuant
to and as provided in the Improvement Act of 1911, Division 7 of the Streets
and Highways Code of the State of California.
§8. The said proposed work is to be done under and proceedings
therefor are to be under and pursuant to the said Improvement Act of 1911.
§9. Notice is hereby given that the 7th day of August, 1962, at
the hour of 2:00 o'clock P.M., are the day and hour when, and the Council
Chambers of this City Council in the City Hall in the City of National City is
the place where, any and all persons having any protest or objection to
said proposed work or to the extent of said assessment district, or to the
proposed grades, may appear before the City Council of the City of National
City and show cause why said proposed work should not be carried out in
accordance with this Resolution of Intention. Protests or objections must
be in writing and must be delivered to the City Clerk of said City of National
City not later than the hour herein set for hearing protests or objections.
§10. The report of the City Engineer pursuant to the provisions
of the Special Assessment Investigation, Limitation and Majority Protest Act
of 1931, and the report of the City Manager and the City Engineer of the
hearing on said report are on file with the City Clerk of National City and
may be examined inter office.
§11. The National City Star News is hereby selected as the
newspaper in which this resolution shall be published and in which all other
publications regarding the proceedings pursuant to this Resolution of Intention
shall be made. The City Clerk is hereby directed to certify to the adoption of
this resolution and to cause said resolution to be published in the manner pro-
vided by law.
§12. The City Clerk is hereby directed to mail notices of the
adoption of this resolution as provided in said Improvement Act of 1911,
postage prepaid, to all persons owning real property which is proposed to be
assessed to pay any part of the cost of said work whose names and addresses
appear on the last equalized assessment roll or as known to the City Clerk.
§13. The Street Superintendent of the City of National City is
hereby directed to cause to be conspicuously posted along the line of the
contemplated work and on all open streets within the said assessment district
notices of the passage of this Resolution of Intention in the time, form and
manner provided by law.
