Home My WebLink AboutCC RESO 8189RESOLUTION NO. 8189 RESOLUTION AUTHORIZING MAYOR TO EXECUTE EASEMEN1S AND .BILL OF SALE WHEREAS in the judgment of the City Council, expedient easements Company, it is and for the best interest of the city that certain be granted to the California Water & Telephone NOW THEREFORE, be it resolved by the City Council that the Mayor of the City of National City, be and is hereby authorized and directed to execute the following easements: (I) Easement to California Water & Telephone Company dated August 28, 1962, copy of which is attached as exhibit (a) and Company exhibit is hereby incorporated as reference; (2) An easement to California Water & Telephone dated August 15, 1962, copy of which is attached as (b) and is hereby incorporated as reference. Be it further resolved that the Mayor of the City of National City be and is hereby authorized and directed to execute that certain bill of sale to the California Water & Telephone Company, copy of which is attached as exhibit (c) and is hereby incorporated as reference. Be it further resolved that the City Clerk is hereby authorized and directed to 1962. attest each of the above documents. ' e rights and easements herein granted shall be for the purpose of maintaining, operating, inspecting,.repairing and using a water main or mains and appurtenances thereto, ooe with the right of ingress into and egress therefrom for all purposes. It is hereby agreed that in the event CITY sells, leases or in any manner transfers the land adjacent to or over- lying said easement, CITY shall issue its Purchase Order to Company for the installation of approximately 230 feet of 8-inch water main to be constructed and installed within Thirtieth Street, said Purchase Order to cover all costs incurred by COMPANY, including overhead, appurtenances and cost of connection of said main to Company's water main in National Avenue, all to the end that the water mains serving said Thirtieth Street shall be entirely within the dedicated portion of Thirtieth Street and National Avenue. 4. Upon completion by COMPANY of the work called for in said Purchase Order and as referred to in Paragraph 3 hereof, COMPANY shall quitclaim to CITY the easement set forth above.
