RESOLUTION OF CITY OF NATIONAL CITY
URGING.ADOPTI.ON.OF SENATE.BILL 1031
WHEREAS, the law of the State of California for many years
last past has provided that the municipalities of this state are
responsible in damages to injuries caused as a result of operation
of motor vehicles or of the failure of a city to properly maintain
its public property; and
WHEREAS, historically, the stability of the financial
position of a city demands that its treasury not be subject to pay-
ment of claims for which the municipality is not responsible; and
WHEREAS, a recent decision of the Supreme Court of the
State of California has overturned the traditional principle that

a city can be for the negligence of its employees.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL
CITY, CALIFORNIA DOES RESOLVE AS FOLLOWS:
That the function of making new laws under the Constitution
of the State of California is properly vested in the legislative
and not the judicial branch of government.
That the recent decision of the Supreme Court of the State
of California attempts to take away from the legislature of Cali-
fornia its jurisdiction to determine what the law of the State of
California shall be regarding the doctrine of soverign immunity.
That the City Council of the City of National City hereby
urges that the legislature adopt Senate Bill 1031 restoring protec-
tion to the cities of this state against claims for damages.
That the Clerk is authorszed and directed to send copies of
this resolution to SENATOR GEORGE MILLER, SENATOR STEPHEN P. TEALE
and SENATOR HUGO FISHER.
PASSED AND ADOPTED this 25th day of April, 1961.
