RESOLUTION OF THE CITY OF
NATIONAL CITY REGARDING SEWAGE DISPOSAL
WHEREAS, for the past 20 years the City of National City
and the City of San Diego have worked together in a joint effort
to solve their sewage disposal problems, and to this end did make
and execite four separate contracts, the same being on file in
the offi,:e of the City Clerk of the City of National City as
Document Numbers 9599, 17033, 17045 and 18181, and in the office of
the City Clerk of the City of San Diego as Document Numbers 335438,
435339, 435340, and 449111, to which reference is hereby made, and
WHEREAS, the City of San Diego is making preparations for
construc`:ion of new sewage disposal facilities which are commonly
referred to as the Metropolitan Sewage System, and
WHEREAS, on the 12th day of April, 1961 the City of San Diego
did make an offer to the City of National City regarding its
particip,3tion in the Metropolitan Sewage System, in words and figures
as follows:

National City will make available to San Diego the
use of its streets where necessary for the construction
operation and maintenance of the interceptor sewer line
of the Metropolitan System, subject to protection to
other utilities already constructed therein and subject
to the replacement of the street according to the exist-
ing and customary standards used in National City.
2. San Diego will accept the sewage from National City
in the above interceptor for transportation and treatment.
At its option National City can determine whether the
arrangement for the transportation and treatment of the
sewage shall be:
(a) Under the existing contractual agreement;
(b) Under the Sewage Disposal Agreement of 1960; or
(c) Under a year-to-year basis upon rates computed
annually."
WHEREAS, on the 25th day of April 1961 the City Council of
National City did accept said offer to participate in the Metropolitan
Sewage System and did authorize its City Manager and City Attorney
to meet with representatives of the City of San Diego for the
purpose of preparing a new contract which would provide that the
amounts to be paid by National City for services would be computed
annually, and
WHEREAS, on the 2nd day of May 1961 a proposed draft of a
contract for the granting to the City of San Diego of the right to
use National City public streets in construction of the South Bay
Interceptor line, and also the participation of the City of National
City in the Metropolitan Sewage System was submitted for the consid-
ation of the City of San Diego, and
WHEREAS, on the 5th day of May 1961 the present City Attorney
of the City of San Diego did advise the City of National City that
he would be unable to do anything with reference to the proposed
draft of said contract until his return from vacation in June, and
WHEREAS, at all times since the 2nd day of May 1961 National
City's representatives have been willing and able to meet with
represenatives of the City of San Diego for the purpose of preparing
a contract in accordance with the above described offer and acceptance,
but durirg all of said time the City Attorney of the City of San
Diego has failed and neglected to communicate further with them
regarding these matters.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY
DOES RESOLVE AS FOLLOWS:
I. The City Council of the City of National City hereby
requests that the City Council of the City of San Diego
furnish it copies of the minutes of any meeting of the
City Council of the City of San Diego at which the draft
of said proposed contract, submitted on May 2, 1961, was
discussed by the City Council of the City of San Diego.
2. The City Council of the City of National City hereby
requests that the City Council of the City of San Diego
determine whether or not it expects to call upon the City
of National City to continue after September 5, 1963
to transport through the National City sewage lines City
of San Diego sewage in excess of 200 million gallons
annually.
3. The City Council of the City of National City hereby
requests the City Council of the City of San Diego to
define specifically the terms and conditions referred to
in City of San Diego Resolution No. 167504 to which the
City of San Diego requests City of National City's
agreement.
4. The City .Clerk' . of the City of National City is hereby
authorized and directed to file a certified copy of this
resolution with the Clerk of the City of San Diego, and
to mail a copy of this resolution to each councilman of
the City of San Diego.
